Article 10: Definitions <br /> Section 10.1: Definitions <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 10-58 <br /> <br />excavation; or the placement of a manufactured home on a foundation. Permanent construction does not <br />include land preparation, such as clearing, grading, and filling; nor does it include the installation of <br />streets and/or walkways; nor does it include excavation for a basement, footings, piers, or foundations or <br />the erection of temporary forms; nor does it include the installation on the property of accessory buildings, <br />such as garages or sheds not occupied as dwelling units or not part of the main structure. For a <br />substantial improvement, the actual start of construction means the first alteration of any wall, ceiling, <br />floor, or other structural part of the building, whether or not that alteration affects the external dimensions <br />of the building. <br />State Agency <br />Every department, agency, institution, public authority, board, commission, bureau, division, council, <br />member of Council of State, or officer of the State government of the State of North Carolina. <br />State Clearinghouse <br />The clearinghouse agency established by the North Carolina Department of Administration under the <br />North Carolina Environmental Policy Act. <br />State Mandate <br />The minimum Rules adopted by the Environmental Management Commission for application to North <br />Carolina's water supply watersheds, as required by the Water Supply Watershed Protection Act. The <br />purpose of the Act, as stated in its opening paragraph, is "... to protect and enhance the quality of the <br />State's surface water supplies by establishing a cooperative program of water supply protection to be <br />administered by local governments consistent with statewide management requirements established by <br />the Environmental Management Commission (EMC)." (See related definition “Water supply watershed”). <br />Stockyard / Livestock Market <br />A facility where livestock are kept temporarily awaiting purchase and/or transport; such facilities may <br />include enclosed pavilions, grandstands, paddocks, and stalls. <br />Storage of Goods <br />A land use where secured space, indoors or outdoors, is rented to tenants for the safeguarding and/or <br />keeping of general merchandise, refrigerated goods, and other personal items on a short or long term <br />basis. 311 <br />Stormwater Collection System <br />Any conduit, pipe, channel, curb, or gutter for the primary purpose of transporting (not treating) run-off. A <br />stormwater collection system does include vegetated swales, swales stabilized with armoring or <br />alternative methods where natural topography prevents the use of vegetated swales (subject to case-by- <br />case review), curb outlet systems or pipes used to carry drainage underneath built-upon surfaces that are <br />associated with development controlled by the provisions of 15A NCAC 2H 1003(c)(1). <br />Stream <br />A body of concentrated flowing water in a natural low area or natural channel on the land surface <br />Stream Buffer <br />An area of land adjacent to a stream or a FEMA-identified floodplain, whichever is greater, which, except <br />as permitted within this Ordinance, must remain undisturbed in its natural state. Streams are identified by <br />any of the following means: <br />a) Shown as solid blue lines or as broken blue lines on the USGS Quadrangle maps, <br />b) Shown as a water feature in the Orange County Soil Survey, or <br />c) A water feature identified by a field determination of County staff trained in surface water <br />identification through the North Carolina Division of Water Quality (NCDWQ). <br /> <br />311 New definition of existing land use. <br />205
