Article 10: Definitions <br /> Section 10.1: Definitions <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 10-45 <br /> <br />Land use(s) engaged in offering a variety of technical, trade, continuing education, vocational and skills <br />training. Includes facilities providing workforce education and college transfer academic programs and <br />may include institutions that maintain athletic teams and offer on-site living accommodations (i.e. <br />dormitories) but not approved by the North Carolina Department of Public Instruction. <br />Semi-Cutoff Fixture <br />An outdoor fixture shielded or constructed in such a manner that it emits no more than 5% of its light <br />above the horizontal plane of the fixture, and no more than 20% of its light ten degrees below the <br />horizontal plane of the fixture. <br />Septic, Off-Site <br />An off-site system is a wastewater system as defined in GS 130A-334(15) where any components of the <br />systems serving two or more facilities are located on property other than the building lot that is under <br />common ownership or control. This approval does not apply to a wastewater system entirely contained on <br />multiple adjoining lots or tracts of land under common ownership or control which are considered a single <br />system per GS 130A-334(15) and subject to permitting pursuant to 15A NCAC 18A .1938(j). <br />Septic System, Alternative <br />Any approved ground absorption sewage treatment and disposal system other than an approved privy or <br />an approved septic tank system. <br />Septic Tank System <br />A subsurface sanitary sewage system consisting of a septic tank and a subsurface disposal field. <br />Setback <br />Yard space other than a court unoccupied and unobstructed by any structure or portion of a structure <br />from thirty inches above the general ground level of the graded lot upward, except as specifically provided <br />in these regulations; provided, however, that fences and walls may be permitted in any setback subject to <br />height limitations established generally or for the district and, further provided that poles, posts and other <br />customary accessories, ornaments, furniture and landscaping shall be permitted in any setback if they do <br />not constitute substantial impediments to free flow of light and air across the setback or violate provisions <br />of these or other regulations regarding visibility. <br />Sexually Oriented Devices <br />Any artificial or simulated Specified Anatomical Area or other device or paraphernalia that is designed <br />principally for Specified Sexual Activities but shall not mean any contraceptive device. <br />Sexually Oriented Business <br />A business which offers its customers or adult patrons any device, activity or demonstration depicting <br />Specified Sexual Activities , or which is intended to appeal to sexual interests, titillation or arousal of the <br />customer or adult patron. A sexually oriented business shall include an adult establishment as in NCGS § <br />14-202.10(2) and, in addition, without limitation shall include: Adult Arcade, Adult Bookstore, Adult Video <br />Store, Adult Cabaret, Adult Motel, and Adult Escort Agency. <br />Short Term Rental 308 <br />Temporary lodging facility composed of a building or group of attached or detached buildings composed <br />of units intended primarily for rental or lease to transients. <br />Short Term Rental Small – Host Occupied: <br />A dwelling occupied by a host, which provides up to three guestrooms for overnightup to one week of <br />rental or lease. <br /> <br />308 Consistent with direction from the BOCC and County’s Attorney office staff has combined existing overnight  <br />accommodation uses (i.e. bed and breakfast, bed and breakfast inn, county inn, hotel/motel, tourist home, etc.)  <br />into the following land use categories.  Originally, staff had recommended creating a overarching category (i.e.  <br />Short Term Rental) and have subcategories.  After meeting with the County Attorney on March 4, 2019, staff has  <br />changed this recommendation.  <br />202
