Article 10: Definitions <br /> Section 10.1: Definitions <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 10-33 <br /> <br />h) Minor adjustment and repair of carburetors; <br />i) Adjustment and repair of brakes; <br />j) Emergency repair of wiring; <br />k) Minor motor adjustments not involving removal of the head or crankcase; <br />l)a) Sales of beverages, packaged foods, tobacco products and similar convenience goods for <br />customers, as accessory and incidental to the principal operations; and <br />m)b) Provision of road maps and other travel information to customers; <br />n) Provision of restroom facilities; and <br />o) State motor vehicle inspections. <br />A service station is not a repair garage nor a body shop. Uses permissible at a service station do not <br />include major mechanical and body work, straightening of body parts, painting, welding, storage of <br />automobiles or trucks not in operating condition or other operations involving noise, glare, smoke, fumes <br />or other characteristics to an extent greater than normally found in service stations. <br />Multiple Use <br />The combination on one lot of two or more principal uses, excluding outdoor advertising signs. (Under <br />some circumstances, a second use may be regarded as accessory to the first, and thus a multiple use is <br />not established.) <br />Net Assets <br />The equity value of real property such as land, buildings, Certificates of Deposit, Checking and Savings <br />accounts, money market accounts, stocks, bonds, cash, IRA of KEOUGH accounts, gold or precious <br />metals, and business equipment. Family or personal assets such as furniture, automobiles, wheelchairs <br />or other special equipment, household goods, boats and recreational vehicles are not included. <br />New construction <br />Structures for which the “start of construction” commenced on or after March 16, 1981, and includes any <br />subsequent improvements to such structures. <br />Night Club, Bar, or Pub <br />An establishment that allows food, alcoholic drink and/or entertainment. <br />Non-Conformance <br />Non-conformities are: <br />a) Lots; <br />b) Uses of land without structures or with minor structures only; <br />c) Uses of major structures and premises; <br />d) Characteristics of Use; and <br />e) Structures <br />which were lawful but would be prohibited, regulated or restricted by the enactment of this Ordinance or a <br />subsequent amendment thereto. Non-conformity may also be created by lawful public taking or actions <br />pursuant to a court order and have the same effect as violations of this Ordinance, if undertaken privately. <br />Non-Conversion Agreement: <br />A document stating that the owner will not convert or alter what has been constructed and approved. <br />Violation of the agreement is considered a violation of the ordinance and, therefore, subject to the same <br />enforcement procedures and penalties. The agreement must be filed with the recorded deed for the <br />property. The agreement must show the clerk’s or recorder’s stamps and/or notations that the filing has <br />been completed. <br />Non-Encroachment area <br />The channel of a river or other watercourse and the adjacent land areas that must be reserved in order to <br />discharge the base flood without cumulatively increasing the water surface elevation more than one foot <br />as designated in the Flood Insurance Study report. <br />Non-Point Source Pollution <br />191
