Article 5: Uses <br /> Section 5.8: Standards for Childcare & Educational Facilities <br /> <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 5-97 <br /> <br />5.8.2 Child Care Facilities <br />(A) Use Standards <br />(1) Standards in Commercial and Industrial Districts <br />(a) At least 100 square feet of outdoor play space per child client shall be <br />provided. <br />(b) Outdoor play/exercise space shall be fenced or otherwise enclosed on all <br />sides and shall not include driveways, parking area or land unsuited by <br />other usage or natural features for children's play space. All required <br />fences shall comply with the regulations of this Ordinance. The minimum <br />height in any case shall be three feet. <br />(c) The minimum lot area for the first eight children clients shall be 10,000 <br />square feet. The minimum additional area for multiples of eight children <br />clients shall be 2,000 square feet. <br />(B) Standards for of Evaluation for Class B Special Use Permit <br />(1) Submittal Requirements <br />In addition to the information required by Section 2.7, the following shall be <br />submitted as part of the application: <br />(a) Where a State license is required to operate the facility, Eevidence that <br />the minimum requirements to qualify for a State of North Carolina child <br />care facility license have been satisfiedsaid license have been, or will be, <br />met shall be submitted. <br />(b) A floor plan of the proposed child care facility, showing the use and <br />dimensions of each room and the location of entrances and exits. <br />(2) Standards of Evaluation <br />(a) Facilities involving the care of children and adolescents shall The child <br />care facility is to be located in an area which is free from conditions <br />dangerous to the physical and moral welfare of the children. 192 <br />(b) Where a State license is required to operate the facility, the applicant <br />shall demonstrate Tthe minimum requirements to qualify for a State of <br />North Carolina child care facility licensesaid license are satisfied. <br />(c) There is direct frontage and access on a public State-maintained road. <br />(d) Adequate access to and from the site as well as adequate space off the <br />road right of way, is provided for the safe pick up and discharge of <br />children clients and is provided in such a manner that traffic generated <br />by the child care facility is not disruptive to adjacent residentially <br />developed properties. <br />(e) All child pickclient pick up and drop offs shall be on site, with proper <br />vehicle stacking area equivalent to three cars. <br />(f) The site plan shall show how the facilities will be screened from adjacent <br />properties. A Type-B, 30-foot buffer shall be provided around child care <br />buildingthe facility and play outdoor area in accordance with Section <br />6.8.6. These buffers will effectively screen the view of any outdoor play <br />area, and reduce noise associated with the child carefacility. <br /> <br />192 All standards geared towards uses involving the care of children and/or adolescents are being moved to a new  <br />section herein.  <br />103
