Article 5: Uses 72 <br /> Section 5.5: Standards for Residential Uses <br /> (4) Only the replacement of units on an existing mobile home space shall be <br /> permitted, provided the following conditions are met: <br /> (a) The total number of units does not exceed the number existing at the <br /> time that the mobile home park became non-conforming; and, <br /> (b) The existing waste treatment system is functioning properly. <br /> (5) Removal and replacement of such units shall not be considered expansion of the <br /> non-conforming use. <br /> (6) New, or portions of existing, Home Parks that have been previously approved, <br /> but have not constructed substantial improvements, including, but not limited to, <br /> water systems, roads, parking areas, recreational facilities and mobile home <br /> pads, or do not have sewage disposal systems installed by the date of adoption <br /> of this section shall meet all applicable standards as set forth in this Ordinance. <br /> 5.5.65.5.7 Mobile Homes on Individual Lots <br /> (A) General Standards of Evaluation <br /> (1) Mobile homes, as principal residential buildings on individual lots, in existence at <br /> the time of the adoption of this section may be improved by replacement of the <br /> mobile home with another mobile home in accordance with the following: <br /> (a) The number of mobile home units may not be increased beyond the <br /> number in existence before replacement. <br /> (b) The replacement mobile home must not create non-conforming yards or <br /> setbacks. <br /> (c) Replacement mobile home units on individual lots are not required to <br /> meet lot area and dimensional or lot coverage standards, but must meet <br /> setback requirements as well as those requirements specified in <br /> Subsections (4)and (5) below, if applicable. <br /> (2) Individual mobile homes may be erected on any lot where the use is permitted, <br /> provided it is in compliance with the requirements of the zoning district and all <br /> other applicable regulations. These zoning requirements include, but are not <br /> limited to: lot area and dimension; front, rear, and side yard setbacks; and lot <br /> coverage. <br /> (3) Individual tracts of land may be created for the purpose of erecting a mobile <br /> home provided all requirements of this Ordinance, and any other applicable land <br /> development standards are met. <br /> (4) In addition to the requirements contained in Subsections (1)through (3)above, <br /> the following requirements must be met in the Residential 1 (R-1) District: <br /> (a) The mobile home must be placed on a permanent support system (See <br /> definition of"support system", Article 10 of this Ordinance). <br /> (b) The mobile home must be skirted. <br /> (5) In addition to the requirements contained in Subsections (1)through (3)above <br /> the following requirements must be met in the Agricultural Residential (AR) <br /> district: <br /> (a) The mobile home must be skirted. <br /> (b) The home may be placed on a permanent support system, if desired. If <br /> a solid concrete or masonry perimeter foundation is used, the exterior <br /> covering material shall not extend below the top of the foundation. <br /> Orange County, North Carolina—Unified Development Ordinance Page 5-54 <br />
