12 <br /> The Planning Board Ordinance Review Committee (ORC) has reviewed this item at several ORC meetings <br /> beginning in January of 2017. Agenda materials from these various meetings can be viewed at: <br /> http://www.orangecountync.gov/departments/planning and inspections/orange county planning board (p <br /> b).php#. <br /> Staff has finalized an amendment package (Attachment 3) that: <br /> a. Collapses existing tables as contained in Section(s) 5.2.1 (general use zoning districts), 5.2.2 <br /> (EDD general use zoning districts), and 5.2.3 (Conditional Zoning districts) into a centralized <br /> permitted use table. <br /> b. Collapses similar land uses into single land use categories. <br /> c. Modifies Article 10 Definitions of the UDO to incorporate new and/or revised definitions of <br /> various land uses consistent with the proposed new table. <br /> d. Incorporates modifications to the Economic Development Hillsborough (EDH) districts as <br /> discussed by the BOCC late in 2016. <br /> e. Includes processes allowing for `reasonable accommodations' as requested by the County <br /> Attorney's office. <br /> Attachment 3 contains the UDO text amendment package. Attachment 1 contains a summary of the project <br /> including frequently asked questions concerning the impacts of this amendment package. <br /> These amendments are expected to be on the BOCC's public hearing agenda on April 2, 2019. <br /> Analysis: As required under Section 2.8.5 of the UDO, the Planning Director is required to: `... cause an <br /> analysis to be made of the application and, based upon that analysis, prepare a recommendation for <br /> consideration by the Planning Board and the Board of County Commissioners'. <br /> The amendments are necessary to address the legal sufficiency of the UDO with respect to the findings of <br /> Byrd versus Franklin by spelling out allowable and prohibited land uses. Staff is eliminating the <br /> unnecessarily repetitive, and often confusing, delineation of allowable land uses by creating a central table <br /> of permitted uses and has combined similar land uses into single categories to ensure uniformity with <br /> respect to application of development criteria and permitting. <br /> Planning Director Recommendation: The Planning Director recommends approval of the Statement of <br /> Consistency, as contained in Attachment 2, and the UDO Text Amendment, as contained within Attachment <br /> 3. <br /> FINANCIAL IMPACT: Consideration and approval will not create the need for additional funding for the <br /> provision of County services. Costs for the required legal advertisement for the text amendment will be paid <br /> from FY2018-19 Departmental funds budgeted for this purpose. Existing Planning staff included in the <br /> Departmental staffing budget will accomplish the work required to process these amendments. <br /> RECOMMENDATION(S): The Planning Director recommends the Planning Board: <br /> 1. Review the proposed amendments to the UDO, <br /> 2. Deliberate on the proposal as desired, <br /> 3. Consider the Planning Director's recommendation(s), and <br /> 4. Make a recommendation to the BOCC on: <br /> a. The Statement of Consistency for proposed UDO Text Amendment(s) (Attachment 2), and <br /> b. Proposed UDO Text Amendment(s) (Attachment 3). <br /> in time for the April 2, 2019 Public Hearing. <br />
