DocuSign Envelope ID:66F168C2-3C54-4274-9428-4F16B3F1802A <br /> EXHIBIT D <br /> Community Home Trust GROUND LEASE <br /> (Revised 4-11-12) <br /> (New PEP 9/14/16) <br /> (Revised 1-27-16) <br /> THIS LEASE ("this Lease" or"the Lease")made and entered into this day of <br /> , 20 ,by and between the COMMUNITY HOME TRUST <br /> ("CHT" or"Lessor") and ("Lessee""). <br /> WHEREAS, CHT is organized for the purpose of developing and preserving decent, <br /> affordable housing opportunities for low and moderate income people who might otherwise not <br /> be able to afford to own a home; and <br /> WHEREAS, CHT uses long term land leases as a tool to provide and preserve affordable <br /> housing; and <br /> WHEREAS, the Lessee enters into this Lease to obtain those benefits to which the Lessee <br /> is entitled under the Lease and to further the charitable purposes of the Lessor; and <br /> WHEREAS, Lessor and Lessee recognize the special nature of the terms and conditions <br /> of this Lease, and each of them, with the independent and informed advice of legal counsel, <br /> freely accepts these terms and conditions, including those terms and conditions that may affect <br /> the marketing and resale price of the Leasehold Estate; <br /> NOW THEREFORE, in consideration of the foregoing recitals, of mutual promises of <br /> Lessor and Lessee, and of other good and valuable consideration, the receipt and sufficiency of <br /> which are hereby acknowledged, Lessor and Lessee agree as follows: <br /> ARTICLE 1: Letters of Stipulation and Acknowledgment <br /> 1.1 LETTERS: In order to assure that Lessee fully understands and accepts the unique <br /> nature of this Lease, Lessor requires that Lessee and Lessee's Counsel review and sign the <br /> Lessee's Letter of Stipulation and Lessee's Attorney's Letter of Acknowledgement in the forms <br /> attached to this lease as Exhibits A and B. <br /> ARTICLE 2: Demise of Leased Premises <br /> 2.1 LEASED PREMISES: Lessor leases to Lessee and Lessee hires from Lessor, the <br /> Land and any improvements thereon(referred to in this Lease as the "Leased Premises") <br /> described in the attached Exhibit C: LEASED PREMISES. Lessee takes the Leased Premises <br /> "as is" as of the date of this Lease. <br />
