13 <br /> The Tax Assessor has indicated that this could be used as such a test for affirming agriculture use <br /> legitimacy, however, there would be some shortcomings associated with this approach. <br /> • Not all agriculture property is assigned"use value" designation. <br /> • There is a difference in defining a farm depending on whether you're viewing from a planning <br /> context or a use context. <br /> • The property may have been sold to a developer and a lapse exists between the transaction and <br /> the use designation,particularly is'the transfer happens between January and July. The tax <br /> records will not show the new owner because the value is based on the use as of January 1. <br /> Verification with the Revenue Department may be necessary. <br /> • A developer can take an option on a"use value"property and offer the owner a bonus if the <br /> owner clears the property prior to relinquishing possession.
