Article 5: Uses 145 <br /> Section 5.6: Standards for Commercial Service Uses <br /> 5.6.3 Eating and Drinking Establishments161 <br /> (A) Use Standards <br /> (1) Shall have frontage, and obtain access from, a public roadway. <br /> (2) Buildings housing nightclubs, bars, and pubs shall not be located within 200 ft. of <br /> a residential structure. <br /> (3) Drive-thru facilities shall only be permitted within the CC-3, GC-4, EDE-2, EDB-2, <br /> EDH-4, and MPD-CZ Zoning Districts. <br /> 5.6.4 Funeral Homes <br /> (A) Use Standards <br /> (1) Shall not be permitted as a Conditional Use District. Refer to Section 5.1.3 of <br /> this Ordinance. <br /> (2) On-site Crematoria shall only be permitted within the 1-1 and 1-2 Zoning Districts. <br /> 5.6.5 Garden Center164 <br /> (A) Use Standards <br /> (1) Rental of moving vehicles shall be permitted as a customary accessory <br /> use.Ibb <br /> (B) Standards of Evaluation <br /> (1) Outdoor display and storage of goods will be permitted. <br /> (2) Outdoor storage of bulk goods shall be located to the rear or side of the primary <br /> building and screened on three sides by an eight foot high opaque wall or fence. <br /> (3) Outdoor storage for bulk goods shall be limited to 1,500 square feet per acre of <br /> the zoning lot. <br /> 5-.63-35.6.6 Massage Business <br /> (A) Genera' Standards for Evaluation <br /> (1) Must comply with the Ordinance for the Control of Massage and Massage <br /> Establishments <br /> (2) The submittal of construction plans for all existing and proposed buildings <br /> housing the massage business. The construction plans shall include floor plans <br /> and cross sections showing the proposed use of all portions of such buildings. <br /> (3) For existing buildings, certification by the Orange County Building Inspector that <br /> the structure(s) complies with the North Carolina Building Code and all related <br /> construction codes. <br /> Bold Red Strikethrough Text in instances where existing language is being eliminated. Staff added the word structure to the standard for clarification. <br /> 163 This reflects existing limitations on where drive-thru facilities can be developed within the County. <br /> 164 Regulations governing the development of a Garden Center were somehow included as part of the regulations <br /> for a Massage Business. Staff is correcting the error and moving the standards to the appropriate location. <br /> 165 We have several garden centers in the County that rent vehicles for moving(i.e. U-Haul trucks,etc.). We are <br /> adding language in Bold Red Underlined Text to make sure previous determinations made by staff that such an <br /> activity is a customary accessory use are being added.
