Hcwever, the likelihood of
this penalty being impcsed is slight because the
superintendent's duties in this statutory scheme are
ministerial.
Another statute places the duty of correcting a violation
[or "exception") of classroom size standards with the local
board of education. That section states that:
"If the superintendent determines the requirements
have not been met, he shall make a report to the next
local board of education meeting. The local board of
education shall take action to meet the requirements
of the statute, If the local board cannot
organizationally correct the exception and if any of
the conditions set out in G.S, 115C-301(g)(1) exist,
A brief summary of the present
2005 school year is attached.
- id.C, Gen, Stat. ~ 115C-301(i),
classroom size standards for the 2009-
