Notwithstanding the provisions of Articles 5 . C . and 5 . D . above, Landlord shall have the <br /> right to lease shop spaces , not to exceed 1 , 200 square feet per store, located in the Shopping <br /> Center to an ice cream or yogurt store (similar to a Bressler ' s or a TCBY) , an " exclusive, <br /> upper- end " candy store, a health food store, a submarine sandwich shop similar in <br /> operation to Subway, or a pizza restaurant or other type of restaurant facility selling <br /> prepared and precooked food for take-out " e* or with an eat-in area which will seat no <br /> more than 25 customers, and Landlord may lease or sell the out-parcels located on Exhibit <br /> " A " to a nationally-known restaurant similar in operation to the restaurants listed below, <br /> provided such restaurants ( 1 ) are operating their businesses in the same manner as they <br /> operate as of the date of this Lease, (2) do not violate the restrictions described in Article <br /> 2 . A. herein, (3 ) only sell beer and wine for on-premises consumption ancillary to the sale of <br /> food products and such beer and wine sales do not exceed fifty percent (50 %) of the <br /> business conducted therein, and (4) do not, without Tenant' s prior written approval (which <br /> approval may be withheld in Tenant' s sole and absolute discretion) , sell alcoholic beverages <br /> other than beer and wine . <br /> McDonald ' s Hardees <br /> Pizza Hut Kentucky Fried Chicken <br /> Pizza Inn Churches Fried Chicken <br /> Roy Rogers Arby's <br /> Burger King Dairy Queen <br /> Tastee Freeze Taco Bell <br /> EWendy ' s Bojangles <br /> Restaurants located within the Shopping Center shall be limited to those of national or <br /> regional chains with the majority of their business in take- out sales . In addition, Landlord <br /> may lease space, not to exceed 7 , 500 square feet, to an up - scale, quality restaurant, mutually <br /> acceptable to Landlord and Tenant, and such restaurant shall be located within the area <br /> outlined in blue on Exhibit "A" , attached hereto , said up- scale restaurant shall have the right <br /> to sell alcoholic beverages , provided the sale of said beverages is ancillary to the sale of <br /> food and said sales do not exceed fifty percent (50 %) of the business conducted therein . <br /> However, no more than three (3 ) restaurants shall be permitted in the Shopping Center. <br /> 23 <br />
