4 <br />ORANGE COUNTY BOARD OF COMMISSIONERS <br />RESOLUTION IN CONCEPTUAL SUPPORT OF CONGESTION MITIGATION <br />AND AIR QUALITY FUNDING ALLOCATION TO ORANGE COUNTY, NORTH <br />CAROLINA FOR A TRANSIT CENTER INCLUDING A PARK AND RIDE <br />FACILITY AND NEW ORANGE PUBLIC TRANSPORTATION INTRA- <br />HILLSBOROUGH ROUTE <br />WHEREAS, the United States Congress included requirements in Section 176(c) <br />of the 1990 Clean Air Act Amendments, Public Law 101-549, November 15, <br />1990, for federally assisted transportation programs to ensure the timely <br />implementation of transportation control measures as specified in the state air <br />quality implementation plans and to provide the highest priority for funding to <br />implement these transportation control measures; and <br />WHEREAS, the United States Congress assured the compliance with these <br />transportation control measures through the provision of the Congestion <br />Mitigation and Air Quality (CMAQ) Program and Categorical Funds in the <br />Intermodal Surface Transportation Efficiency Act (ISTEA), Public Law 102-240, <br />December 18, 1991, and through its reauthorization of the CMAQ Program and <br />Categorical Funds in the Transportation Equity Act of the Twenty First Century <br />(TEA-21), Public Law 95-198, June 6, 1998; and <br />WHEREAS, the CMAC2 program has been officially transcribed into federal <br />surface transportation regulations and policies under Title 23, Chapter 1, Section <br />149 of the United States Code; and <br />WHEREAS, the primary purpose of the CMAQ Program has been to fund <br />transportation projects and programs in air quality non-attainment and <br />maintenance areas which will reduce transportation related emissions; and <br />WHEREAS, the Federal Highway Administration and the Federal Transit <br />Administration have been directed through federal programs to recommend to <br />state transportation departments and local transportation planning organizations <br />the identification of transportation control measures and related projects to <br />provide alternatives to single occupancy vehicle use and to reduce vehicle miles <br />of travel; and <br />WHEREAS, these transportation control measures may include projects far <br />improved public transit, high occupancy shared ride services, employer based <br />transportation management plans and flexible work schedules, and other <br />appropriate projects to reduce vehicle miles of travel in air quality impacted <br />areas: and <br />
