The following standard forms shall be utilized in the administration of the Project: <br /> 1. Form of Agreement: AIA Document A101-2017 Standard Form of Agreement Between Owner and Contractor <br /> where the basis of payment is a Stipulated Sum(Modified);A101-2017 ExhibitA Insurance and Bonds(Modified); <br /> and AIA Document A201-2017, General Conditions of the Contract for Construction. (Modified) <br /> 2. Form of Certificate of Insurance: AIA Document G715 Supplemental Attachment for Acord Certificate of <br /> Insurance 25-S. <br /> 3. Form of Performance Bond and Labor and Material Bond: AIA Document A312-2010 Performance Bond and <br /> Labor and Material Bond. <br /> a. The General Contractor will be allowed to modify the AIA A312-2010 Payment Bond as follows: <br /> 1) Amend second line of Paragraph 6.1 to delete"45 days"and substitute with"60 days". <br /> 2) Amend Paragraph 6 to add subparagraph 6.3: <br /> a) 6.3 The Surety's failure to discharge its obligations under this Section 6 shall not to be deemed to <br /> constitute a waiver of defenses the Surety or Contractor may have or acquire as to a claim. <br /> However, if the Surety fails to discharge its obligations under this Section 6, the Surety shall <br /> indemnify the Claimant for the reasonable attorney's fees the Claimant incurs to recover any sums <br /> found to be due and owing to the Claimant. <br /> 4.
