(Attn: Tony Whitaker) <br /> located at 3708 Lyckan Parkway, Suite 201, Durham, NC 27707 <br /> (hereinafter"Client"),and Soil&Environmental Consultants,PA,a corporation,with its corporate office at 8412 Falls <br /> of Neuse Road,Raleigh,Suite 104,North Carolina,27615(hereinafter"S&EC"). <br /> SITE INFORMATION <br /> S&EC shall provide the services as described below to Client for the project located at West Hill Ave. N and Hwy 70, <br /> Orange County, NC (physical location) <br /> Acreage ± acres PIN 9864392344,9864398253, 9864397758 <br /> SERVICES: <br /> Item 1: Pre-permitting Consultation & Meetings: S&EC will provide consultation services for the transition in to <br /> Section 404 & 401 permitting of the protect "Orange County Northern Campus"to include but not limited to: office <br /> meetings, conference calls,correspondence, initial site plan reviews and protect management. <br /> Item 2: Pre-Construction Notification Application Prep & Submittal: Initial preparation and submittal of the Pre- <br /> Construction Notification Application (PCN) to the US Army Corps of Engineers (USACE) and/or the NC Division of <br /> Water Resources (NC DWR) requesting written concurrence for the use of a General Nationwide Permit and/or a <br /> General Water Quality Certification for the proposed impacts to"waters of the US/State" for the project currently known <br /> as "Orange County Northern Campus". This initial preparation and submittal includes the completion and <br /> compilation of PCN application package, up to two (2) site plan reviews & comments, compensatory mitigation <br /> acceptance request to a mitigation bank/NCDMS (if necessary), correspondence with engineer and/or client associated <br /> with Nationwide Permitting up until the initial submittal of the application to the agencies. The permanent cumulative <br /> impacts (i.e. proposed and existing)for this protect are not to exceed 300 linear feet of important/perennial stream or <br /> '/2 acre of jurisdictional waters or 0.10 acres of jurisdictional wetlands if NWP 18 is being utilized); <br /> Item 3: Post-Submittal Correspondence/Meetings: Post submittal written response required and/or additional <br /> correspondence after the initial submittal of application to the agencies(i.e. USACE Incomplete Application Notification, <br /> NCDWR Request for More Information response and correspondence with client, engineer and agencies etc.), not to <br /> exceed 2 written responses to agencies. This phase shall also include any site plan reviews/comments that may exceed <br /> the 2 reviews/comments identified in Item 2. <br /> Item 4: Road side Delineation: S&EC will review the proposed offsite waterline. Any wetlands and streams(start <br /> points)within the corridor will be flapped. (hereinafter"Services") <br /> NOTE: This proposal does not include correspondence with the US Fish&Wildlife Services pertaining to federally listed threatened <br /> or endangered species, or other surveys or reports that may be requested pertaining to federally listed threatened or endangered <br /> species. Additionally, this proposal does not include correspondence with the NC State Historic Preservation Office or the Office of <br /> State Archeology pertaining to historical or cultural resources. Any or all of these services may be necessary to obtain a Nationwide <br /> Permit or deemed a regulatory condition. Should any of these services be required,a separate proposal including services and fee <br /> estimates will be provided. NOTE: To complete Item 2 of above,the following information will need to be provided from the Client <br /> and/or their representatives;1-signed agent authorization form from the property owner(s);2-Division of Water Resources Application <br /> fee;3-overall site plan,existing conditions&Impact exhibits;4-one(1)hard copy of the stormwater management plan(SMP)and SMP <br /> approval(if received),or Post-Construction Drainage Area Map. NOTE: Decisions regarding permit issuance by governing <br /> regulatory agencies are beyond our control,and as such this agreement is not assuring that a Nationwide Permit Verification or <br /> Water Quality Certification and/or Riparian Buffer Authorization Approval will be issued for this project. <br /> DELIVERABLES: <br /> S&EC shall provide the following deliverables to Client in association with the Services described above. <br /> Item 1: S&EC will provide meeting notes and/or correspondence as requested. <br /> Item 2: S&EC will provide confirmation of the submittal of the PCN to the USACE&NCDWR; <br /> Item 3: S&EC will provide copies of all correspondence to agencies provided to applicant upon request; <br /> Item 4: S&EC will provide an updated sketch map and email summary.
