Article 6: Development Standards 36 <br /> Section 6.14: Stormwater Management <br /> (b) Haw River Arm <br /> 0) N+#F0gen, 3.8 pounds per aGFe per year <br /> ri aG per ear <br /> rrr� ^sp sTT 4 a d�er <br /> (B) The nutrient export from each new development shall be calculated in pounds per acre <br /> per year(using the approved accounting tool) in accordance with the methodologies <br /> approved by the NC BWQDEQ. <br /> (C) If a proposed development subject to nutrient load requirements contributes nutrients <br /> greater than the standards listed above, the developer may install Structural stermwater <br /> AMP-s stormwater control measures (SCMs) 13 to meet the required nutrient load <br /> standards or do a combination of BMP--s SCMs and offset payments to achieve the <br /> standard. <br /> (D) Offset Payments <br /> (1) Offset fees may be permitted to meet the nutrient export levels set for new <br /> development. In order to utilize offset fees, the proposed new development <br /> subject to the nutrient load standards must attain nitrogen and phosphorus <br /> loading rate reductions on-site that meet the following criteria prior to using an <br /> offsite offset measure: <br /> (a) Falls Lake Watershed <br /> (i) 30% or more reduction in both nitrogen and phosphorus loading <br /> from the untreated conditions for any single-family, detached and <br /> duplex residential development disturbing one half acre but less <br /> than one acre; <br /> (ii) 50% or more reduction in both nitrogen and phosphorus loading <br /> from the untreated conditions for any single-family, detached and <br /> duplex residential development disturbing more than one acre; <br /> (iii) 30% or more reduction in both nitrogen and phosphorus loading <br /> from the untreated condition for other development, including <br /> multi-family residential, commercial and industrial development <br /> disturbing 12,000 square feet but less than one acre; <br /> (iv) 50% or more reduction in both nitrogen and phosphorus loading <br /> from the untreated condition for other development, including <br /> multi-family residential, commercial and industrial development <br /> disturbing more than one acre; <br /> (v) 30% or more reduction in both nitrogen and phosphorus loading <br /> from the untreated condition for proposed redevelopment <br /> activities in a designated downtown area that would replace or <br /> expand structures or improvements that existed as of December <br /> 2006. <br /> (b) jerrdaR Lake Watershed <br /> SoxSox neunrds per r, per year nitrogen fer single `tetaGhed <br /> �TTasP � e� � i--rn-crvg �r-Sff�9T �a <br /> and duplex residential development <br /> /tT) Ter peuRds-peFaGFe peF yeaF RitFegeR feF other deyelepment <br /> i nnluding nnmmerniel industrial nd multi family residential. <br /> (2) Offset fees may be paid to the North Carolina EGGGYGtem Cnha3nGement Program <br /> 13 Nomenclature change to ensure consistency with State law. <br /> Orange County, North Carolina—Unified Development Ordinance Page 6-99 <br />
