RIGHT-OF-WAY TOPICS <br /> A. Arthur Minnis Road Update (NCDOT/Nish Trivedi) <br /> In order for NCDOT to pave the unpaved section of Arthur Minnis Road, additional <br /> Right-of-Way must be obtained from property owners. NCDOT has sent letters to <br /> property owners and met with the Orange Grove Road Fire Department for it to follow <br /> up. (Exhibit II.A) <br /> Status: Chuck Edwards, NCDOT reviewed the history on an unpaved section of <br /> Arthur Minnis Road between Rocky Ridge Road and Dodson's Crossroads, which has <br /> been on NCDOT's hold list because additional right-of-way is needed for paving. <br /> Since this matter was last discussed with this group, NCDOT has been working with <br /> the Orange Grove Fire Department and County staff. There have been some <br /> personal visits with four outstanding property owners, and letters sent. One additional <br /> property owner agreed to dedicate the needed right-of-way. NCDOT will try again <br /> with the remaining property owners. Fire Department has expressed its concerns <br /> pertaining to response times, safety, etc. <br /> Chuck Edwards stated that NCDOT has the legal ability to condemn properties to <br /> acquire the necessary right-of-way consistent with State law and that Arthur Minnis <br /> road meets criteria for condemnation. In order to proceed, a request from property <br /> owners and a commitment by the property owners to post funds to go towards partial <br /> funding of the condemnation process is needed.
