Article 5: Uses <br /> Section 5.8: Standards for Childcare & Educational Facilities <br /> <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 5-95 <br /> <br />(2) A floor plan of the proposed child care facility, showing the use and dimensions <br />of each room and the location of entrances and exits. <br />(3) Where a State license is required to operate the facility, evidence that the <br />minimum requirements to qualify for a state Center in a Residence for 3 to 12 <br />Children license have been satisfiedfor said license have been, or will be, met <br />shall be submitted. <br />(B)(C) Standards of Evaluation <br />(1) The Daycare Center in a Residence is to be located in an area, which is free <br />from conditions dangerous to the physical and moral welfare of the children.160 <br />(2) The minimum requirements to qualify for a State of North Carolina child care <br />license are satisfied.161 <br />(3)(1) There is direct frontage and access on a public state maintained road. <br />(4)(2) Adequate access to and from the site, as well as adequate space off the road <br />right-of-way, is provided for the safe pickup and discharge of children clients and <br />is provided in such a manner that traffic generated by the Daycare Center in a <br />Residenceuse is not disruptive to adjacent residentially developed properties. <br />(5)(3) The plot plan shall show how the facilities will be screened from adjacent <br />properties. A Type B 30-foot buffer shall be provided around the Daycare Center <br />in a Residenceuse and play/exercise area in accordance with Section 6.8.6. <br />These buffers will effectively screen the view of any outdoor play area, and <br />reduce noise associated with the child careoperation. <br />(6)(4) Each Daycare Center in a Residence is required to provide at leasta minimum of <br />75 square feet of outdoor play space for every childclient in care. This space <br />may not be located in a required buffer or in an area, which is used or reserved <br />for use as a sewage disposal nitrification field. <br />(7)(5) Fencing is to be provided around the outdoor space, which ensures the <br />protection of the children clients receiving child care and protects adjacent <br />residentially developed properties from trespass. <br />(8)(6) All gates shall be self-closing and self-latching. <br />(D) Additional Standards of Evaluation – Care of Children and Adolescents <br />(1) The Center in a Residence is to be located in an area, which is free from <br />conditions dangerous to the physical and moral welfare of the children.162 <br />5.8.2 Child Care Facilities <br />(A) Use Standards <br />(1) Standards in Commercial and Industrial Districts <br />(a) At least 100 square feet of outdoor play space per child client shall be <br />provided. <br />(b) Outdoor play/exercise space shall be fenced or otherwise enclosed on all <br />sides and shall not include driveways, parking area or land unsuited by <br />other usage or natural features for children's play space.
