Article 5: Uses <br /> Section 5.6: Standards for Commercial Service Uses <br /> <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 5-59 <br /> <br />(1) Submittal Requirements <br />In addition to the information required by Section 2.7, the following shall be <br />submitted as part of the application: <br />(a) Evidence that the requirements of the North Carolina General Statutes <br />Chapter 65 can be achieved and that the standards of the N.C, <br />Cemetery Commission shall be met. <br />(2) Standards of Evaluation <br />(a) A minimum lot size of two acres is provided. <br />(b) The site shall have direct access to a collector or arterial street. <br />(c) There shall be adequate space within the site for the parking and <br />maneuvering of funeral cartilages. <br />(d) No interments shall take place within 30 feet of any lot line.136 <br />5.6.2 Eating and Drinking Establishments137 <br />(A) Use Standards <br />(1) Shall have frontage, and obtain access from, a public roadway. <br />(2) Buildings housing nightclubs, bars, and pubs shall not be located within 200 ft. of <br />a residential structure.138 <br />(3) Drive-thru facilities shall only be permitted within the CC-3, GC-4, EDE-2, EDB-2, <br />EDH-4, and MPD-CZ Zoning Districts.139 <br />5.6.3 Funeral Homes <br />(A) Use Standards <br />(1) Shall not be permitted as a Conditional Use District. Refer to Section 5.1.3 of <br />this Ordinance. <br />(2) On-site Crematoria shall only be permitted within the I-1 and I-2 Zoning Districts. <br />5.6.4 Garden Center140 <br />(A) Use Standards <br />(1) Rental of moving vehicles shall be permitted as a customary accessory use.141 <br />(B) Standards of Evaluation <br />(1) Outdoor display and storage of goods will be permitted. <br />136Aspreviouslyindicated,thereareinstanceswhereexistingstandardsareshownasRedUnderlinedText.Thisis <br />duetotheirrelocationwithinArticle5.IftherearechangesstaffwillidentifysameinBoldRedUnderlinedTextor <br />BoldRedStrikethroughTextininstanceswhereexistinglanguageisbeingeliminated.Theseregulations,for <br />example,aretheexistingstandardsgoverningthedevelopmentofacemetery. <br />137Thiscombinesrestaurants,nightclub,pubs,bars,etc.intoonecentrallandusecategory.Additional <br />developmentstandardswillbeaddedinafuturetextamendment. <br />138ExistingregulationstakenfromSection5.6.1.Staffaddedthewordstructuretothestandardforclarification. <br />139ThisreflectsexistinglimitationsonwheredriveͲthrufacilitiescanbedevelopedwithintheCounty. <br />140RegulationsgoverningthedevelopmentofaGardenCenterweresomehowincludedaspartoftheregulations <br />foraMassageBusiness.Staffiscorrectingtheerrorandmovingthestandardstotheappropriatelocation. <br />141WehaveseveralgardencentersintheCountythatrentvehiclesformoving(i.e.UͲHaultrucks,etc.).Weare <br />addinglanguageinBoldRedUnderlinedTexttomakesurepreviousdeterminationsmadebystaffthatsuchan <br />activityisacustomaryaccessoryusearebeingadded.Additionalregulatorystandardswillbeaddedduringa <br />futureamendmenttoaddressnumberofallowedvehicles,storage,parking,screening,etc. <br /> 55
