Article 5: Uses <br /> Section 5.21: Retail Uses <br /> <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 5-174 <br /> <br />(2) Multiple Uses, identified in Section 5.15.2(C)(1), are permitted in the O/RM <br />zoning district only in accordance with the following standards: <br />(a) The site plan must shall identify the square footage of each structure by <br />type of use. <br />(b) The Principal Use type of Research Facility Without Manufacturing <br />must be established on the site. <br />(c) The Multiple Use shall not exceed 25% of the total square footage of all <br />structures on the site. <br />SECTION 5.21: RETAIL USES <br />5.21.1 Retail <br />(A) Use standards <br />(1) Specific Standards for the LC-1, NC-2, and EC-5 Zoning Districts <br />(a) Uses shall be limited to 12,000 sq.ft. of building area.208 <br />(b) No outdoor sales/displays shall be permitted.209 <br />(2) Specific Standards for the CC-3 Zoning District <br />(a) Uses shall be limited to 24,000 sq.ft. of building area. <br />(b) Outdoor sales/displays shall be permitted subject to the following: <br />(i) No more than 20% of the property area shall be utilized to <br />support outdoor sales/displays. <br />(ii) Displays Sshall not be located within any required parking, septic <br />disposal, or land use buffer area on the property. <br />(iii) Displays shall not block entrances and exists to the structure. <br />(3) Outdoor sales/displays shall be allowed in other districts subject to the <br />following:210 <br />(a) No more than 25% of the property area shall be utilized to support <br />outdoor sales/displays. <br />(b) Displays Sshall not be located within any required parking, septic <br />disposal, or land use buffer area on the property. <br />(c) Displays shall not block entrances and exists to the structure. <br />5.21.2 Country Store211 <br />(A) General Standards for Evaluation <br />(1) Outdoor storage of products shall be permitted in the rear yard of the primary <br />structure and shall be screened from view of adjacent properties. <br />(2) Outdoor storage areas shall not be permitted to encroach upon required parking <br />spaces. <br />208Existingregulationsestablishlimitationsonthedevelopmentofretailusesinthesedistrictstodailytraffictrips. <br />Thisisnotaneffectivemannerofregulatingtheintensityofthelanduse.Staffhasconvertedtheexisting <br />standardintoasquarefootagelimitationtomakeiteasierforthereadertoidentifywhatisandisnotallowed. <br />209Thereareexistingprohibitionsonoutdoorsalesstaffisincorporatingintothenewformat. <br />210Staffisclarifyingandincorporatingexistinginterpretationsontheoutdoordisplay/saleofmerchandise. <br />211ExistingstandardsmovedfromSection5.6.4oftheUDO.Staffisrecommendingkeepingthecategoryfornow. <br /> 135
