Article 5: Uses <br /> Section 5.18: Standards for Miscellaneous ASSEMBLY Uses <br /> <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 5-163 <br /> <br />Section 5.17:SECTION 5.18: STANDARDS FOR MISCELLANEOUS ASSEMBLY <br />USES <br />5.17.15.18.1 ChurchesAssembly Uses <br />(A) General StandardsUse Standards <br />(1) Assembly uses with an occupancy of 300 or more persons shall not be permitted <br />within the Rural Buffer land use classification, as designated by the adopted <br />Comprehensive Plan, as part of a Conditional Zoning District application.196 <br />(B) Standards for all Residential Zoning Districts <br />(1) Assembly land uses shall observe the following minimum setbacks in all <br />residential zoning districts: <br />Churches are required to provide setbacks in residential districts; the minimum shall be <br />as follows: <br />TABLE 5.184.1.A: CHURCH SETBACK STANDARDS IN RESIDENTIAL DISTRICTS <br />SETBACK DISTANCE (FEET) <br />Front 45 <br />Side 50 <br />Rear 50 <br />(C) Standards for LC-1, NC-2, and EC-5 Zoning Districts. <br />(1) Assembly Uses shall not exceed 100 persons at any given time. <br />(2) All activities shall be conducted in doors. <br />5.17.25.18.2 Community Center <br />(A) Submittal Requirements and Standards of Evaluation for Class B Special Use <br />Permit <br />(1) Submittal Requirements <br />In addition to the information required by Section 2.7, the following information <br />shall be supplied as part of the application for approval of this use: <br />(a) A description of the exact type of facility planned, the size of the building, <br />the number of participants; a signed statement from the owners or <br />operators that the facility will be operated by a non-profit organization. <br />(b) A site plan showing the location of the existing and proposed buildings, <br />access points, parking, service areas, and outdoor recreation areas. <br />(c) Building plans for all existing or proposed structures. <br />(d) Landscape plan, at the same scale as the site plan, showing existing or <br />proposed trees, shrubs, ground cover and any other landscape <br />materials. <br />(2) Standards of Evaluation <br />(a) Lot size shall be adequate for the method of sewage disposal, and for <br />the other improvements proposed or required. <br />196ThereareexistingprohibitionswithinSection5.2.3TableofPermittedUses–ConditionalZoningDistricts <br />limitingcertainlandusesfrombeingdevelopedonpropertylocatedwithintheRuralBufferlandusecategory. <br />StaffisincludingsuchprohibitionsinArticle5. <br /> 124
