Attachment 4 <br />Adopted: August 15, 1983 <br />Amended: February 1, 1968 <br />Article IV: Exceptions <br />The following are exempt from the provisions of this ordinance: <br />(1) Construction operations from 7 A.M. to 9 P.M. on weekdays and 8 A.M. to 9 <br />P.M. on weekends for which building permits have been issued, or <br />constn~ction operations not requiring permits; provided all equipment is <br />operated in accordance with the manufacturers' specifications and with all <br />standard equipment, manufacturers' mufflers and noise reducing equipment <br />in use and in proper operating condition. <br />(2) Noises of safety signals, warning devices, emergency pressure relief valves <br />and church bells. <br />(3) Noises resulting from any authorized emergency vehicle when responding to <br />any emergency call or acting in time of emergency. <br />(4) Unamplified noises at street activity (such as fairs or parades) where the <br />participants have a permit for use of the streets, <br />(5) All noises coming from the normal operation of properly equipped aircraft (not <br />including scale model aircrafk). <br />(6) All noises coming from motor vehicles properly equipped with the <br />manufacturers' standard mufflers and noise reducing equipment in use and in <br />proper operating condition. <br />(7) Noise from lawful fire works and noisemakers on holidays. <br />(8) Lawn mowers and agricultural equipment used between daylight and 9 P.M. <br />when operated with all the manufacturers' standard mufflers and noise <br />reducing equipment in use and in proper operating condition. <br />(9) Agricultural equipment operated for farming purposes, <br />Article VI: Burden of Proof Reaarding Exceptions <br />In any proceeding based upon this ordinance, if an exception stated in this <br />ordinance would limit obligation, limit liability, or eliminate either an obligation or liability, <br />the person who would benefit from the application of the exception shall have the <br />burden of proving that the exception applies and that the terms of the exception have <br />been met. <br />35 <br />G:V+dministrative Div\DEBRA\Ordinances\Nolse\Noise Ordinancedoc 3 <br />
