DocuSign Envelope ID: B895344F-E234-49C1-832A-A33DD13A178D <br /> NORTH CAROLINA <br /> CONTRACT AMENDMENT <br /> ORANGE COUNTY <br /> THIS CONTRACT AMENDMENT("Amendment") is made and entered into this 18'b day of December, 2018 by and <br /> between ORANGE COUNTY (hereinafter referred to as "County") and Summit Design and Engineering Services <br /> (hereinafter referred to as"Consultant"). <br /> WITNESSETH: <br /> THAT WHEREAS, the County and Consultant entered into a contract dated July 7, 2018, (hereinafter the "Original <br /> Agreement"), for the provision of consulting services for the refraining of housing program offerings to the County; and <br /> WHEREAS, the County and Consultant desire to amend the Original Agreement while keeping in effect all terms and <br /> conditions of the Original Agreement not inconsistent with the terms and conditions set forth below. <br /> NOW THEREFORE, for and in consideration of the mutual covenants and agreements made herein, the parties agree to <br /> amend the Original Agreement as follows: <br /> 1. In order to ensure the completion of the Services identified in the term of the Original Agreement is amended <br /> to reflect an end date by which all Services shall be completed of December 31, 2018. <br /> 2. Exhibit 1 to the Original Agreement is amended by adding the following tasks and services to the Services to <br /> be provided by the Consultant: Provide a revised design that should be endorsed by a credentialed safety <br /> professional employed or contracted by Summit to ensure compliance with OSHA Safety Standards. The site <br /> should be inspected by the same individual once the shoring system is installed and once per week until the <br /> backfilling phase of the project is complete. Provide site inspections that shall be completed regularly which <br /> include but are not limited to: supervision of daily on-site job start inspections and documentation of site <br /> conditions, assurance of the OSHA defined Competent Person being present, and general safety reviews in <br /> conjunction with the General Contractor. Provide at least two on-site job visits by Summit's Construction <br /> Administrator each project day with written documentation of those visits emailed to the authorized County <br /> representative (one of which could be the daily job start inspection). Provide the formal management and <br /> documentation of weekly project stakeholder updates throughout the project (could be held in conjunction <br /> with the daily on-site job start inspection). <br /> 3. Article 5, Section 5.1.1 is amended to reflect a maximum payable not-to-exceed amount of Sixteen Thousand <br /> Six Hundred Fifty Three Dollars ($16,653.00). <br /> 4. Except for the changes made herein,the Original Agreement shall remain in full force and effect to the extent <br /> it is not inconsistent with this Amendment. In the event that there is a conflict between the Original <br /> Agreement and this Amendment,this Amendment shall control. <br />
