AND BOUNDARY
AGREEMENT
Dan VanderMeer said he requested Patrick Davis to bring the. Board up-to-date on the
Water and Sewer Management, Planning, and Boundary Agreement, and that he requested Ed
Kerwin and Robert Epting to advise the Board what the unrexotved issues are.
Mr.VanderMeer said that Robert Epting provided to the Board of Directors in his January
25,1999 letter his opinion sad concern that certain provisions of the present draft dated October 28,
1995 of the Service Area Boundary Agreement conflict with OWASA's duties under the Agreements
of Sate and Purchase that were entered into separately with The University of North Carolina at
Chapel Hitt, the Town of Chapel hilt, and the Town of Carrboro.
Patrick Davis said he commenced attending the Water and Sewer Boundary Task Force
Meetings in 1994. Utcally there were concerns about how water and sewer utilities would be
managed to order to be compatible with local land use planning growth Management objectives, how
assignments would be made regarding responsibilities for providing services In areas throughout
Orange County where it would be appropriate and desirable to provide public water and sewer
services or, In the event of an unfortunate environmental or public health problem, those services
might be needed to be extended under careful controls.
W. Davis said the Water and'Sewer Boundary Task Force discussed the issue of where
retail water and sewer utility services should be extended and where they.shoutda't be extended.
That resulted In consensus on primary utility service areas and long-term interest areas. Patrick
Davis referred the Board to the map on Appendix A entitled"Proposed Public Waterisewer Service
Boundaries Subject to Addition of Other UtilitieslC.ocalnties." The map Includes the Town of
8iilsborough's extraterritorial planning jurisdiction, corporate U=Its,and what was identified In the
Town of Biilsborough's long-range sewer plan as an alternate build-out of Its sewer service area.
The southern part of the Town of 14iitsborough's projected service area would coincide with the
northern boundary of the rural buffer that Is Identified In the Joint Land Use Plan between Orange
County, the Town of Chapel Wilk and the Town of Carrbore. Mr. Davis said a concern from the
outset was obtaining the Town of KiUsborough's commitment not to provide sewer service into the
rural buffer and Into critical water supply watersheds. That commitment from the Town of
Hillsborough was received early in the discussions and one significant obstacle was overcome-
Mr.Davis said there were subsequent discussions about constraints and language that would
make it clear that OWASA was committed to not providing retail services in areas beyond the urban
transition areas for the Chapel Kilt-Cartboro community. The Board and staff were in agreement
