• The bill and authority does not apply within the Carr and Cheeks voting <br /> precincts of Orange County . <br /> • Agricultural , horticultural and silvicultural ( forestry ) activities that are <br /> exempt from County permitting and land use rules are also exempt from <br /> this bill . As such , open burning under by bona fide agricultural operations <br /> and managed forestry operations is not affected . <br /> • The authority to regulate open burning is limited to the County 's territorial <br /> jurisdiction , and as such does not automatically apply inside municipal <br /> jurisdictions . In order for any new County regulations to apply inside <br /> Towns , the Town boards would need to adopt the same regulations . In <br /> the Orange County - Chapel Hill - Carrboro Joint Planning Area , the towns of <br /> Chapel Hill and Carrboro would need to adopt these standards in order for <br /> them to apply in the " transition areas " north of Chapel Hill and Carrboro * . <br /> Transition areas are areas that are governed by a joint land use plan , but <br /> permit authority is delegated to the respective Towns . <br /> • The County "s Construction and Demolition Waste Recycling Task Force <br /> recently released a report that calls for the County to mandate recycling <br /> or reuse of " recyclable waste material . " The report recommended an <br /> ordinance that would require the separation of materials for recycling or <br /> reuse purposes . Items to be reused or recycled include yard waste and <br /> " non - reusable wood waste " ( i . e . , trees and vegetation cleared from land <br /> for any purpose other than sale as a commodity or chipping for sale ) . The <br /> proposed ordinance would prohibit disposal of such waste through open <br /> burning in the County . <br /> • To implement the ordinance , the County must first address a method for <br /> handling recycled wood waste . The Board of Commissioners will consider <br /> this and other related issues on an upcoming worksession . <br /> Stancil noted that Lake Hogan Farms subdivision , where open burning was <br /> recently an issue , is in the Carrboro transition area . To address this issue in <br /> transition areas under the new legislation , the following would need to occur : <br /> 1 ) the County develops a plan for handling recycled wood waste , 2 ) the <br /> County adopts ordinance prohibiting burning and mandating recycling , and 3 ) <br /> Carrboro passes resolution putting the ordinance into effect within Carrboro 's <br /> jurisdiction . <br /> The BOCC has adopted a resolution that would have agencies using county <br /> funds use open burning as a last resort . <br /> DRAFT CFE 9 / 11 / 00 Minutes Page 2 of 8 <br /> L :\Caro1\CFEMIN\91 100cfeFINAL. doc <br />
