Open Burning Regulation <br /> Summary and Notes <br /> In July , the general Assembly ratified a bill giving Orange County authority to <br /> regulate and prohibit the open burning of trees , limbs , stumps and construction <br /> debris . This authority may be applied as a condition of approval for subdivision <br /> approval and other clearing and development permits . <br /> Notes <br /> • The bill and authority does not apply to Carr and Cheeks voting precincts <br /> within Orange County ( map attached ) . <br /> • Agricultural , horticultural and silvicultural ( forestry) activities that are exempt <br /> from County permitting and land use rules remain exempt from this bill . As <br /> such , open burning under the auspices of bona fide agricultural operations <br /> and managed forestry operations is not affected . <br /> • The authority is limited to the County 's territorial jurisdiction , and as such <br /> does not automatically apply inside the Town 's and their jurisdictions . In <br /> order for the same rules to apply inside Towns , the Town boards will need to <br /> adopt the same regulations . In the Orange County- Chapel Hill - Carrboro Joint <br /> Planning Area , the Towns of Chapel Hill and Carrboro will need to adopt these <br /> standards in order for them to apply in the " transition areas " north of Chapel <br /> Hill and Carrboro * . Transition areas are areas that are governed by a joint <br /> land use plan , but permit authority is delegated to the respective Towns . <br /> • The County 's Construction and Demolition Waste Recycling Task Force has <br /> recently released a report that calls for the County to mandate recycling or <br /> reuse of " recyclable waste material . " This is recommended to be <br /> accomplished through a ordinance that requires the separation of materials <br /> for recycling or reuse purposes , Included among items to be reused or <br /> recycled are yard waste and " non - reusable wood waste " ( i . e . , trees and <br /> vegetation cleared from land for any purpose other than sale as a commodity <br /> or chipping for sale ) . The proposed ordinance would prohibit disposal of such <br /> waste through open burning in the County . <br /> • To implement the ordinance , the County must first address a method for <br /> handling recycled wood waste . (The Board of Commissioners will be <br /> considering this and other related issues on August 30 ) . <br /> * _ The area of Lake Hogan Farms where open burning was recently an issue is in the Carrboro <br /> transition area . To address this issue in transition areas under the new legisation , the following <br /> would need to occur : 1 ) County develops a plan for handling recycled wood waste , 2 ) County <br /> adopts ordinance prohibiting open burning and mandating recycling , and 3 ) Carrboro passes <br /> resolution putting the ordinance into effect within Carrboro 's jurisdiction . <br />
