The amendments are necessary to bring the County's UDO into alignment <br /> with current DEQ regulatory requirements related to the implementation/enforcement of the <br /> `Jordan Lake Rules' as the County no longer has the authority to enforce same. The County still <br /> enforces nutrient reduction strategies within the Neuse River Basin. The proposed amendments <br /> only impacts properties within the Cape Fear River Basin, where the County has no legal <br /> mechanism to implement and enforce nutrient reduction strategies based on current State law. <br /> Planning Director Recommendation: The Planning Director recommends approval of the <br /> Statement of Consistency, as contained in Attachment 1, and the LIDO Text Amendment, as <br /> contained within Attachment 2. <br /> FINANCIAL IMPACT: Consideration and approval will not create the need for additional funding <br /> for the provision of County services. Costs for the required legal advertisement for the text <br /> amendment will be paid from FY2018-19 Departmental funds budgeted for this purpose. <br /> Existing Planning staff included in the Departmental staffing budget will accomplish the work <br /> required to process these amendments. <br /> RECOMMENDATION(S): The Planning Director recommends the Planning Board: <br /> 1. Review the proposed amendments to the UDO, <br /> 2. Deliberate on the proposal as desired, <br /> 3. Consider the Planning Director's recommendation(s), and <br /> 4. Make a recommendation to the BOCC on: <br /> a. The Statement of Consistency for proposed UDO Text Amendment(s) (Attachment <br /> 1), and <br /> b. Proposed UDO Text Amendment(s) (Attachment 2). <br /> in time for the March 7, 2019 Public Hearing. <br />
