Harvey, Current Planning Supervisor <br /> Craig Benedict, Planning Director <br /> DATE: December 11, 2018 <br /> SUBJECT: INFORMATION ITEM - Unified Development Ordinance (UDO) Text <br /> Amendments Clarifying Enforcement of Nutrient Standards <br /> Orange County's Planning Department has commenced work on a text amendment to <br /> the UDO regarding enforcement of nutrient standards within the Cape Fear River Basin, <br /> consistent with recent changes in State law. <br /> BACKGROUND: Orange County regulates erosion & sedimentation control, as well as <br /> stormwater runoff, for non-farm land disturbing activities under the general oversight of <br /> the North Carolina Department of Environmental Quality (DEQ). This includes the <br /> enforcement of nutrient reduction strategies (i.e. reducing pollution/nutrients entering <br /> local water bodies). <br /> In 2017 the State chose to delay the implementation/enforcement of these nutrient <br /> reduction strategies within the Cape Fear River Basin. The proposed amendment <br /> seeks to bring the County's UDO into alignment with State law. <br /> The attached map provides detail on the location of the impacted river basin within the <br /> County. This amendment only impacts properties within the Cape Fear River Basin. <br /> Nutrient reduction strategies shall still be enforced within the Neuse River Basin <br /> consistent with State law. <br /> TIMELINE: The targeted dates for review are as follows: <br /> • Planning Board Ordinance Review Committee (ORC): November 7, 2018 <br /> • Development Advisory Committee (DAC): December 6, 2018 <br /> • Legal Sufficiency Determination: To be determined <br />
