She said staff is working with the architect and
construction manager, and will bring this item back to the Board when there are additional
options worked out.

10. County Attorney’s Report
John Roberts said a lawsuit was filed today challenging the constitutionality of the
partisan gerrymandering, which is similar to the case filed in Pennsylvania that the
Pennsylvania Supreme Court upheld, and found the gerrymandering to be unconstitutional. He
said it is based on state constitution claims, and is thus unlikely that any federal court would
intervene, and it should be decided at the State level.
Chair Dorosin asked if there is also a case in federal court that has been successful.
John Roberts said there is a federal case that will ultimately get to the US Supreme
Court, but it only challenges the United States Congressional seats of North Carolina. He
thinks this case will either be sent back down, or ruled against the plaintiffs, at which point a NC
constitutional challenge could be filed in a similar manner to what was filed today.

11. *Appointments

a.
