8 <br /> 1 <br /> 2 BACKGROUND <br /> 3 • Developed collaboratively by staff from all jurisdictions <br /> 4 • Reviewed by Managers from all jurisdictions <br /> 5 • Reviewed by legal representative from each jurisdiction <br /> 6 • Unanimously approved by The Solid Waste Advisory Group ("SWAG") <br /> 7 <br /> 8 AGREEMENT BETWEEN PARTIES <br /> 9 • Recognizes UNC-Chapel Hill and UNC-Healthcare as important stakeholders but are <br /> 10 not parties to the Agreement <br /> 11 • UNC- Chapel Hill and UNC-Healthcare continued participation on SWAG and as non- <br /> 12 voting members regarding the Solid Waste Programs Fee <br /> 13 <br /> 14 TERMS AND TERMINATION <br /> 15 • Agreement continues until Terminated by the parties jointly; but <br /> 16 • Individual party may withdraw with sufficient notice and, in recognition of the economic <br /> 17 effect on the other parties, payment of a withdrawal fee <br /> 18 <br /> 19 NOTED CHANGES: <br /> 20 MANAGEMENT OVERSIGHT COMMITTEE ESTABLISHED ("MOC") <br /> 21 Establishes the MOC made up of the County Manager and a Manager from each Town <br /> 22 • UNC and UNC-Health are invited to appoint a non-voting member <br /> 23 • Acts as a forum to discuss issues related to <br /> 24 ➢ Recycling, Solid Waste Management, Facilities and Services <br /> 25 ➢ Rate structure <br /> 26 ➢ Submits information to SWAG for final approval and recommendation <br /> 27 <br /> 28 ILA Process Flow Chart <br /> 29 <br /> 30 C&D AND MSW LANDFILLS <br /> 31 • County maintains financial, regulatory and environmental responsibility for the <br /> 32 Construction and Demolition ("C&D") and Municipal Solid Waste ("MSW") Landfills <br /> 33 • Towns and County will direct C&D Waste from projects with local government funding, <br /> 34 including School construction and renovation projects, to the C&D Landfill <br /> 35 <br /> 36 MUNICIPAL SOLID WASTE ("MSW") COLLECTION AND DISPOSAL FACILITIES <br /> 37 • The Towns and County each maintain authority and responsibility for MSW collected <br /> 38 and transferred within their respective jurisdictions. <br /> 39 • If any of the jurisdictions plan and develop alternative solid waste disposal facility <br /> 40 options the Agreement may be amended as necessary to clarify access, ownership and <br /> 41 operation. <br /> 42 • County will manage storm debris at the C&D Landfill and other identified locations <br /> 43 throughout the County. Towns remain responsible for collection and monitoring of their <br /> 44 storm debris <br /> 45 <br /> 46 RECYCLING <br /> 47 • County to continue current recycling programs <br /> 48 • Elimination or Substantial changes must first be discussed by the MOC and then <br /> 49 presented to SWAG <br />
