Draft Planning Board Minutes D R A F T
July 7, 2004
552
553 AGENDA ITEM #9: PRELIMINARY PLAN (PRESENTED BEFORE ITEM 8B)
554 a. Davi-Net Subdivision-Eno Township; 10 lots
555 Presenter: Eddie Kirk
556
557 Eddie Kirk: The Concept Plan was reviewed in 2002. This is property is at the corner of Mt.
558 Herman Church Road and NC 10. The Concept Plan was approved unanimously by this Board
559 on Apri14, 2002 with 26 lots. Since that time, the area north of Old NC 10 was determined to be
560 needed for repair area for the septic fields in the adjacent mobile home park. This application is
561 considered Phase I of Davi-Net. This is the area on the south side plus an area north of NC 10
562 including a 300 foot strip along Mt. Herman Church Road which will be used for open space.
563 There are only 10 lots proposed of the 26 on the Concept Plan. The proposal is for 2 roads
564 which will be public. Eaoh lot will have individual wells and septic tanks. Each lot is
565 approximately .92 acres. There is 39.8% of open space or about 9.11 acres. The Planning Staff
566 recommends approval of this preliminary plan subject to the Resolution of approval.
567
568 Nicole Graysmith: How many lots were in the original p]an on this side of the road?
569
570 Eddie Kirk: There were 8 and now there are 10.
571
572 lay Bryan: What is in the attachment 4 letter?
573
574 Eddie Kirk: What is reflected is an additional right-of--way on both Old NC 10 and Mt. Hermon
575 Church Road.
576
577 Barry Katz: You can't have repair areas on one side of the road and residents on the other but
578 with the railroad tracks, is it possible to connect those repair areas?
579
580 Eddie Kirk: Environmental Health said the owners have had approval from the railroad for a
581 long time to put this repair area in.
582
583 Steve Yuhasz: My understanding was that in conjunction with the approval of the mobile home
584 park there was approval for a boring under the railroad if access is needed. The Health
585 Department is aware of that.
586
587 Hunter Schofield: Does the railroad have easement?
588
589 Steve Yuhasz: If they don't own that property, they have almost exclusive control over it. I
590 believe it is just an easement. The current ownership of the property depends on what the
591 ownership of the property was in 1832. Is there an easement on record or a letter of approval of
592 that use?
593
594 Mrs. McBain: Yes.
595
596 Steve Yuhasz: This does not directly impact what we are discussing.
597
3~
14
