Davi-Net Subdivision-Eno Township; 10 lots <br />555 Presenter: Eddie Kirk <br />556 <br />557 Eddie Kirk: The Concept Plan was reviewed in 2002. This is property is at the corner of Mt. <br />558 Herman Church Road and NC 10. The Concept Plan was approved unanimously by this Board <br />559 on Apri14, 2002 with 26 lots. Since that time, the area north of Old NC 10 was determined to be <br />560 needed for repair area for the septic fields in the adjacent mobile home park. This application is <br />561 considered Phase I of Davi-Net. This is the area on the south side plus an area north of NC 10 <br />562 including a 300 foot strip along Mt. Herman Church Road which will be used for open space. <br />563 There are only 10 lots proposed of the 26 on the Concept Plan. The proposal is for 2 roads <br />564 which will be public. Eaoh lot will have individual wells and septic tanks. Each lot is <br />565 approximately .92 acres. There is 39.8% of open space or about 9.11 acres. The Planning Staff <br />566 recommends approval of this preliminary plan subject to the Resolution of approval. <br />567 <br />568 Nicole Graysmith: How many lots were in the original p]an on this side of the road? <br />569 <br />570 Eddie Kirk: There were 8 and now there are 10. <br />571 <br />572 lay Bryan: What is in the attachment 4 letter? <br />573 <br />574 Eddie Kirk: What is reflected is an additional right-of--way on both Old NC 10 and Mt. Hermon <br />575 Church Road. <br />576 <br />577 Barry Katz: You can't have repair areas on one side of the road and residents on the other but <br />578 with the railroad tracks, is it possible to connect those repair areas? <br />579 <br />580 Eddie Kirk: Environmental Health said the owners have had approval from the railroad for a <br />581 long time to put this repair area in. <br />582 <br />583 Steve Yuhasz: My understanding was that in conjunction with the approval of the mobile home <br />584 park there was approval for a boring under the railroad if access is needed. The Health <br />585 Department is aware of that. <br />586 <br />587 Hunter Schofield: Does the railroad have easement? <br />588 <br />589 Steve Yuhasz: If they don't own that property, they have almost exclusive control over it. I <br />590 believe it is just an easement. The current ownership of the property depends on what the <br />591 ownership of the property was in 1832.
