44 <br /> 5. Miscellaneous <br /> 5-1 Notices. <br /> (a) Any communication required or permitted by this Deed of Trust must be in <br /> writing. <br /> (b) Any communication under this Deed of Trust shall be sufficiently given and <br /> deemed given when delivered by hand or on the date shown as the date of delivery on a United <br /> States Postal Service return receipt, if addressed as follows: <br /> (i) if to the ,NONPROFIT CORPORATION,to <br /> I <br /> Hillsborough, NC 27278 <br /> (ii) if to the Deed of Trust Trustee,to <br /> Gary Donaldson <br /> Trustee Orange County <br /> Post Office Box 8181 <br /> Hillsborough,NC 27278; and, <br /> (iii) if to the County, addressed as follows: <br /> Manager, Orange County, <br /> Post Office Box 8181 <br /> Hillsborough,NC 27278; or, <br /> (c) Any communication sent to the Deed of Trust Trustee shall also be sent to the 1 <br /> NONPROFIT CORPORATION and the County. <br /> i <br /> (d) Any addressee may designate additional or different addresses for <br /> I <br /> communications by notice given under this Section to each of the others. <br /> 1 <br /> 6-2 Successors; Assignments <br /> (a) This Deed of Trust shall be binding upon, inure to the benefit of, and be <br /> enforceable by the ,NONPROFIT CORPORATION, the Property Owners,the <br /> Deed of Trust Trustee and the County and their respective successors and assigns. <br /> i <br /> (b) The Property Owner shall not sell, lease,transfer or otherwise dispose of all or any <br /> part of the Mortgaged Property or any interest therein without the County's prior written consent. <br /> 1 <br /> 6-3 No Marshalling. The Property Owner waive any and all rights to require <br /> marshalling of assets in connection with the exercise of any remedies provided in this Deed of <br /> i <br /> Trust or as permitted by law. <br /> 6-4 Governing Law and Venue. The Property Owner, <br /> NONPROFIT CORPORATION,the County and the Deed of Trust Trustee intend that North <br /> Carolina law shall govern this Deed of Trust. Any and all disputes between the parties shall be <br /> brought in the Superior Court of Orange County. M <br /> i <br /> 6-5 Covenants Running with the Land.
