13 <br /> <br />Durham, NC, a Perkins + Will cost estimating sub-consultant, and the recently engaged <br />Construction Manager at Risk firm, Barnhill Construction of Durham, NC. <br /> <br />Development Agreement Highlights <br />The following are notable Development Agreement point updates for the Board: <br /> <br />A. Library Location with the “203 Project”: “The Commons” schematic design contemplates the <br />Library to occupy a full, contiguous floor on the second level of the facility. With regard to <br />the facility design (Article Three, Section C of the Development Agreement): <br />“The Town, as Owner of the Property, will be primarily responsible for procuring <br />all necessary development approvals for the Project to permit the Orange County <br />Southern Branch Library on the Building's lower floors, the proposed uses on the <br />upper floors as described herein and the required associated parking.” <br />The design honors the Orange County Southern Branch Library Development Agreement in the <br />following manner: <br /> <br />• The placement of the library at the center of the second story will allow it to <br />dominate the space while also drawing your attention to the other elements of the <br />building. The design of the interior will allow the customers to see into the library <br />and for the library customers to see what is also going on in the floor below. The <br />library will be accessible to all customers by the grand entrance staircase and two <br />(2) elevators. <br />• The design of “The Commons” still allows for the library to be on 1 floor for <br />optimum operational efficiency <br />• While another scheme allowed for the library to be on the first floor, it was not <br />recommended because it did not meet the design/use needs of all partners, did not <br />allow for collaborative opportunities, diminished visibility for the other parties, and <br />was the most expensive of all the schemes. (See metrics table) <br /> <br />B. Parking: The Schematic Design incorporates the necessary 50 on-site public parking <br />spaces for the library as required by the Carrboro Development Ordinance as well as by the <br />Development Agreement (Article Three, Section M of the Development Agreement): <br />“The parties agree that in the event on-site parking spaces will be owned and <br />paid for by the County shall be available for use by Library patrons during normal <br />Library operating hours. This number of spaces will be determined during the <br />permitting and design of the project. These spaces will be made available to the <br />Town while the Library is closed.” <br /> <br />C. Cost Allocation & the Associated Timeframe for Agreement: Since the Schematic Design is <br />largely complete, the County and Town are now within the 45 day period of evaluating the <br />design and its estimated costs (Article IV, Section A): <br />“The parties acknowledge that Exhibit C represents their general understanding <br />of the cost sharing; however, the parties agree to negotiate in good faith the fair <br />and equitable share of all costs associated with this project as soon as possible <br />after the Schematic Design work is completed. If the parties are unable to come <br />to an agreement within forty-five (45) days after the Schematic Design <br />Acceptance date of September 26, 2018, then either party may terminate this <br />agreement by providing ten (10) days advance written notice to the other party of <br />its intention to terminate this agreement.” <br />This agreement must be completed by day 45 after the Schematic Design Acceptance Date, or <br />by November 9, 2018.
