DocuSign Envelope ID:7883307E-C860-4560-99B8-EE98E3EB6B35 <br /> Initial Mere <br /> Account Terms and Conditions <br /> Permanent Placement Agreement Customer understands that our employee may only be hired by them after <br /> customer has worked them through LF for a period of twenty--five work days. Customer further understands that after <br /> the 25th day, if customer offers employment to the LF employee,that LF no longer has any employer related obligations or <br /> responsibility effective with customer's date of hire. Customer agrees to notify LF of their intent to hire the LF employee. <br /> Customer understands and agrees that no additional fee will be charged for this permanent placement,unless customer fails <br /> to abide by the twenty-five working days requirement. In the event that customer violates this agreement and hires the LF <br /> personnel before the conclusion of twenty-five working days,customer understands a breach of contract penalty of$2500 will <br /> be due and payable immediately and failure to pay this penalty will result in legal action for the recovery of this penalty fee plus <br /> all reasonable attorneys'fees and court cost. It is further understood that once a customer has worked an LF employee they <br /> are not free to hire the LF employee for one year from the date the LF employee first worked for the customer, unless they <br /> have elected to hire them at the end of twenty-five working days, Should customer violate this part of the permanent <br /> placement agreement, the same breach of contract penalty will be paid and all fees for the collection thereof. <br /> Customer understands and agrees that the information provided is for the purpose of obtaining the services of LF on <br /> credit,,unless paying with a credit card. Customer further understands and agrees that all accounts or monies due <br /> to LF shall be paid in accordance with the credit terms stated herein. Customer authorizes the issue of a joint party <br /> check with LF from the General Contractor and/or owner if monies owed to LF become delinquent. <br /> For Customers Utilizinci Certified Flamiers <br /> Labor Finders provides employees that have been certified to perform traffic safety control flagging services on roadways in NC. <br /> Because they are temporary employees, Labor Finders has no control over whether they show up on time to your work zone. We <br /> make every effort to ensure they are dispatched from our location timely,so as to arrive at your site early or on time. In the event <br /> our employee agrees to work on your site but fails to show up to your work site or makes unapproved stops on the way to a work <br /> site,causing them and or the crew to be late,we reserve the right to terminate said employee.This is how seriously we take this. <br /> As a result of these rare but unfortunate poor decisions of our temporary employees,there will be times when our flaggers are <br /> either late to your site or fail to show up at all. In most cases we will notify you in advance of these situations, if we are aware of it. It <br /> is likely however,there will be times when we,due to no fault of our own are not aware, In these instances,because we didn't <br /> have knowledge In advance,we will not be able to provide you with notification prior to their fate arrival or no arrival. it is incumbent <br /> upon your organization to ensure you have a backup plan in place,so that your equipment and work site can operate without our <br /> employees. We will not be financially responsible for any lost time,lost material,or financially responsible in any way when these <br /> incidents occur. <br /> Our branch professionals work tirelessly to ensure you receive your flaggers on time,but we have no control over them once they <br /> leave our branch. Should you need it,we can help with establishing a backup plan by offering to certify any of your employees to <br /> flag in the event our crew is late or doesn't show up. This way your equipment can still begin operations on time.
