11 <br /> 1 property in Durham County. The maps contain property in both Orange and Durham counties, <br /> 2 effectively making them `shared maps'. While this update will not result in a change in identified <br /> 3 flood data within Orange County (i.e. no increase or decrease in flood area on property in <br /> 4 Orange County's planning jurisdiction), the data on the shared FIRMs is being changed. As a <br /> 5 result, Orange County must modify existing regulation(s) to reflect the new FIRM effective date <br /> 6 of October 19, 2018. <br /> 7 <br /> 8 This amendment needs to be adopted by October 19, 2018 in order for Orange County to <br /> 9 remain eligible for participation in the NFIP. A copy of the recommended language is contained <br /> 10 within Attachment 4. <br /> 11 <br /> 12 As previously indicated, participation in the NFIP is voluntary and floodplain management <br /> 13 standards are only enforceable within a specific community. County regulations, for example, <br /> 14 only apply to property owners within Orange County's planning jurisdiction. This also means <br /> 15 only those property owners benefit from Orange County's participation within the program. It is <br /> 16 up to individual communities (i.e. Carrboro, Chapel Hill, Hillsborough, Mebane, etc.) to adopt <br /> 17 and enforce floodplain management regulations. Staff is unaware of pending FIRM changes <br /> 18 impacting any of the aforementioned municipalities requiring similar amendment(s)/action. It is, <br /> 19 however, incumbent on those individual communities to coordinate such action with State <br /> 20 emergency management officials. <br /> 21 <br /> 22 Planning Director Recommendation: The Planning Director recommends approval of the <br /> 23 Statement of Consistency, as contained in Attachment 3, and the UDO Text Amendment, as <br /> 24 contained within Attachment 4. <br /> 25 <br /> 26 Planning Board Recommendation: At its September 5, 2018 meeting, the Board voted <br /> 27 unanimously to recommend approval of the Statement of Consistency and the UDO <br /> 28 amendment package. An excerpt of minutes and the signed Statement of Consistency from this <br /> 29 meeting are included in Attachment 2. <br /> 30 <br /> 31 Chair Dorosin asked if the only change here are the dates. <br /> 32 Michael Harvey said yes, and there is no increase in flood property area for parcels of <br /> 33 property in Orange County. He said the problem is a technical one where the County needs to <br /> 34 insure that the ordinance reflects the most recent FIRM map. <br /> 35 <br /> 36 A motion was made by Commissioner Price, seconded by Commissioner Rich for the <br /> 37 Board to open the public hearing. <br /> 38 <br /> 39 VOTE: UNANINOUS <br /> 40 <br /> 41 NO PUBLIC COMMENT <br /> 42 <br /> 43 A motion was made by Commissioner Price, seconded by Commissioner Rich for the <br /> 44 Board to close the public hearing the public hearing.
