Many of the comments made in the June 2, 2004 Planning Board meeting <br />paralleled the comments made in the April 7, 2004 meeting (see attached Draft <br />June 2, 2004 Planning Board minutes). The Board did revote on the four items <br />found in the negative in the April 7, 2004 meeting and had the following results: <br />Articles: 8,.8.30c.2 Landscape Design (Specific finding) 4-4 vote (no finding); <br />8.8.304 Multiple shared use opportunities (Specific finding) 8-0 <br />vote (unanimous approval); <br />8.2.1.b.1 Use will maintain or promote the public health safety and <br />general welfare (General finding) 8-0 vote (unanimous <br />approval); <br />8.2.1.b.3. Use is in harmony with the area and in compliance with <br />the plan for the physical 4evelopment of the County <br />(General finding) 3-5 vote (denial) <br />RECOMMENDATION: The Planning Board recommended DENIAL of the Special Use <br />Permit to the BOCC based on the application as submitted does <br />not meet the criteria for approval. The Planning Board found in <br />the negative on Article 8.2.1.b.3 general finding which relates to the <br />use being in harmony with the area.. <br />However, the Planning Board stated that if the BOCC is inclined to <br />approve the Special Use Permit, then it thought it best to vote to <br />recommend approval of the conditions in the attached Resolution of <br />Approval. <br />The Administration recommends closing the public hearing and <br />APPROVING the application for the Middle School #3 based on the <br />site plan dated May 7, 2004, evidence presented at the May 24 <br />Quarterly Public Hearing, and evidence presented at the .tune 2 <br />continuation of the Public Hearing at the Planning Board meeting. <br />Recommendation of Approval is subject to: <br />a. Positive findings as detailed in Exhibit A attached to the <br />Resolution of Approval, and <br />b. Conditions 1 through 14 as set forth in the attached Resolution <br />of Approval, and <br />c. Either reduction of the impervious surface to 12% or less before <br />final staff approval of the site plan or by building a structural <br />BMP per zoning ordinance requirements should impervious <br />exceed 12%. <br />
