25 <br />3. Fifty feet of additional right-of--way from the center of the existing right-of--way shall be <br />dedicated along the north side of West 10. This additional right-of--way shall extend the <br />entire distance of the Property, The 100 foot buffer shall start at the edge of the right-of--way. <br />4, Sidewalks on the north side of the proposed additional road right-of--way on West 10 shall be <br />constructed azrd maintained. A sidewalk shall extend along the drive on the eastern side of <br />the Property to the parking area behind the school, <br />5. Two access entrances on West 10 shall be permitted. Driveway permits from NCDOT shall <br />be obtained prior to issuance of building permits. In order to take advantage of multiple <br />shared use opportunities and to provide a safe intersection at West Ten Road, a portion of the <br />eastern drive maybe relocated to the County's property to the East and, if so, a cross access <br />easement must be provided for County Attorney approval and recorded prior to recordation <br />of the Special Use Permit. If the eastern drive is not thus relocated, a stub out easement shall <br />be provided to the eastern property line for potential connection to the County's property to <br />the East when developed and a cross access easement provided for Cowzty Attorney approval <br />and recorded prior to recordation of the Special Use Permit. <br />6. All NCDOT construction requirements shall be met. Right and left turn lanes shall be <br />constructed to NCDOT standards for both driveways as required by NCDOT. <br />7. The applicant shall deconstruct or move the existing houses and/or accessory structures on <br />the Property. <br />8. The area to the east of the 60 parking spaces, near the athletic fields is designated as future <br />parking and authorized to be constructed when needed. <br />9. Lighting and landscaping plans shall be modified and approved prior to issuance of any <br />building permits, hrstallation in accordance with approved plans shall be complete prior to <br />issuance of certificate of occupancy. <br />10. The property is located in the EDD and Upper Eno Protected Watershed. The maximum <br />impervious surface ratio permitted without a structural BMP is 12 percent.. The site plan <br />contains no BMP and shows an impervious surface ratio of 1.3 percent. Either the impervious <br />surface ratio must be reduced to 12 percent or less before final staff approval of the site plan, <br />or a structural BMP must be included in the site plan and constructed and operated to <br />ordinance standazds. <br />11. The above-described tracts of the Property shall be recombined into one tract prior to the <br />issuance of the Special Use Permit. <br />12. Curb and gutter is required for all parking and drive areas. <br />13. If any condition of this Special Use Permit shall beheld invalid or void, then this Special Use <br />Permit shall be void in it's entirety and of no effect. <br />14. This Special Use Pernit shall automatically expire within twelve (12) months of the date of <br />approval if the use has not commenced or construction has not commenced or proceeded <br />unless a timely application for extension of the time limit is approved by the Board of County <br />Commissioners as provided by Section 8.4.11 of the Orange County Zoning Ordinance. <br />G:\CurtentPlanning\Eddie\MiddleSchoolWcs(t0\Spccial Use Permit Resolution <br />
