BACKGROUND: Recently, county fire marshals became eligible to participate in the North Carolina Firemen's and Rescue Squad Worker's Pension Fund. The North Carolina State Firemen's and Rescue Squad Worker's Pension Fund allows members who meet the requirements to receive a monthly pension, upon retirement. State law requires, that in order for members to be eligible to participate in the Pension Fund and receive a year of credit in the fund, members must attend thirty -six (36) hours of training in the calendar year. The Fire Marshal received ninety -four (94) hours of training in fire /arson investigations and child death investigations. Certificates of training are included with the agenda abstract. North Carolina General Statute 58 -86 -25 requires submission of a complete and certified roster of eligible staff annually. The governing body, the County Commissioners, must certify the annual certification roster. The certified roster and minimum training requirements determine eligibility for Pension Fund credit as well as line of duty death benefits. The roster document, which is utilized both for membership in the NC State Firemen's Association and for Pension Fund Certification, is attached and lists two individuals. However, under Pension Fund Certification guidelines, only the Fire Marshal is eligible for certification. The other individual listed is for Firemen's Association purposes only, and the BOCC is only addressing Pension Fund Certification for the Fire Marshal. As an additional point of information, individual County fire departments submit their own Pension Fund Certification rosters based on approval by their respective boards of directors and signature of approval by the respective board's president.
