8 <br />Orange County Board of Commissioners <br />Page :3 <br />September 24, 1996 <br />1. The qualified voters of each district shall nominate <br />candidates and elect members who reside in the district for seats <br />apportioned to that district; and the qualified voters of the <br />entire county shall nominate candidates and elect members <br />apportioned to the county at large, if any. <br />2. The qualified voters of each district shall nominate <br />candidates who reside in the district for seats apportioned to <br />that district, and the qualified voters of the entire county <br />shall nominate candidates for seats apportioned to the county at <br />large, if any; and the qualified voters of the entire county <br />shall elect all of the members of the board. <br />3. Members shall reside in and represent the districts <br />according to the apportionment plan adopted, but the qualified <br />voters of the entire county shall nominate all candidates for and <br />elect all members of the board. <br />The Board has directed that consideration be given to the <br />third electoral district option described above. This option is <br />authorized by the North Carolina General Assembly provided an <br />electoral district apportioruaent plan can be adopted creating <br />districts "as nearly equal as practicable" and provided there is <br />no violation of the Voting Rights Act, guidelines of <br />which have been or will be presented to you along with <br />apportionment plans developed by the Planning staff for your <br />consideration. There is no legal impediment to creating the <br />electoral district plan favored by the Board of Commissioners. <br />If a decision is made to create electoral districts, a map of <br />those districts must be drawn along with a written description of <br />those districts and both must be made available for public <br />inspection in the office of the Clerk to the Board. <br />Very truly yours, <br />GEG/lsg <br />xc: John M.
