Revised December 2016 <br />ORANGE COUNTY <br />AMENDMENT TO DEVELOPMENT AGREEMENT <br />NORTH CAROLINA <br /> <br />THIS AMENDMENT, made and entered into this the 28TH day of September, 2018, by and between the County of <br />Orange, a body politic and corporate of the State of North Carolina, (“County”), and EmPOWERment, Inc. <br />(“Provider”); <br /> <br />WITNESSETH: <br /> <br />WHEREAS, the County and Provider entered into a Development Agreement on or about September 21, 2018 <br />whereby the County granted the Provider FY 2015-16 HOME funds to relocate and rehabilitate one single-family <br />residence to be used as rental housing for a veteran whose family income is less than 60% of the HUD area median <br />income, which residence will be located at 507 Terrell Road, Hillsborough, North Carolina (“Original <br />Agreement”); <br /> <br />WHEREAS, the County and Provider desire to amend the Original Agreement, while keeping in effect all terms <br />and conditions of the Original Agreement not inconsistent with the terms and conditions set forth below. <br /> <br />NOW THEREFORE, for and in consideration for the mutual covenants and agreements made herein, the parties <br />agree to amend the Original Agreement as follows: <br /> <br /> <br />EXHIBIT A <br />Property Description <br />Containing 0.26 acres and being designated as B-R1 of the Recombination & Division Property Surveyed for <br />EMPOWERMENT, Inc. according to the plat survey of Steve F. Yuhasz, Registered Land Surveyor, dated, June 1, <br />2005, and duly recorded in the Orange County Registry in Plat Book 97, Page 160. The conveyance is made <br />subject to such utility easements, if any, as may traverse the subject property. <br />PIN# 9864-69-2600 <br /> <br />Except for the changes made to EXHIBIT A herein, the Original Agreement shall remain in full force and effect to <br />the extent it is not inconsistent with this Amendment.
