ai <br />-18- <br />Proceeding <br />The franchise authority must either approve or deny the operator's FCC form 1240, form 12.35 <br />and form 1205 on the basis of whether the requested rates aze reasonable. This determination <br />must be based upon a finding of fact, <br />The franchise authority should adopt the Consultant's report as its own, and the public must be <br />granted an opportunity to offer comment on the matter. It is suggested that a public comment <br />period on the matter coincide with a regular public meeting, <br />To be valid, the Rate Order must be: <br />Executed following the conclusion of a public meeting where the County Board grants <br />interested parties an opportiurity to comment; <br />2, Adopt the report as its own -required by FCC rules (this requires a motion to adopt, and a <br />vote); and <br />Approve and execute the Rate Order, <br />4. Serve the Rate Order and a copy of the Report upon Time Warner Cable.. <br />It is appropriate for public comment to be heard, as related to the various rate issues, at the next <br />scheduled County Board meeting to deliberate this matter. Although a statutory public hearing is <br />not required, it is customary and good public policy to call for public comment in these matters. <br />The comment period maybe publicized by issuing a press release to the print and electronic <br />media or announced in other appropriate ways, Time Warner Cable must be notified of the <br />public meeting and advised to have a representative present to respond to the findings contained <br />in this Report and any questions elected and appointed County officials and the public may pose, <br />
