Article 5: Uses <br /> Section 5.6: Standards for Commercial Service Uses <br /> <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 5-56 <br /> <br />(b) A permitted Principal Use must be established on at least 50% of the <br />total square footage of structures on the site. <br />(c) Multi-family dwellings shall not exceed 25% of the total square footage of <br />all structures on the site. <br />SECTION 5.6: STANDARDS FOR COMMERCIAL SERVICE USES <br />5.6.1 Nightclubs, Bars and Pubs112 <br />(A) General Standards for Evaluation <br />(1) Buildings for nightclubs, bars and pubs shall not be located within 200 feet of a <br />residence. <br />5.6.25.6.1 Cemetery113 <br />(A) Submittal Requirements and Standards of Evaluation for Class B Special Use <br />Permit and <br />(1) Submittal Requirements <br />In addition to the information required by Section 2.7, the following shall be <br />submitted as part of the application: <br />(a) Evidence that the requirements of the North Carolina General Statutes <br />Chapter 65 can be achieved and that the standards of the N.C, <br />Cemetery Commission shall be met. <br />(2) Standards of Evaluation <br />(a) A minimum lot size of two acres is provided. <br />(b) The site shall have direct access to a collector or arterial street <br />(c) There shall be adequate space within the site for the parking and <br />maneuvering of funeral cartilages <br />(d) No interments shall take place within 30 feet of any lot line.114 <br />5.6.2 Eating and Drinking Establishments115 <br />(A) Use Standards <br />(1) Shall have frontage, and obtain access from, a public roadway. <br />(2) Buildings housing nightclubs, bars, and pubs shall not be located within 200 ft. of <br />a residential structure.116 <br />(3) Drive-thru facilities shall only be permitted within the CC-3, GC-4, EDE-2, EDB-2, <br />EDH-4, and MPD-CZ Zoning Districts.117 <br />5.6.3 Funeral Homes <br />(A) Use Standards <br />(1) Shall not be permitted as a Conditional Use District. Refer to Section 5.1.3 of <br /> <br />112 Combined with the Eating and Drinking Establishment use category. <br />113 This was moved from the existing Miscellaneous land use category contained in Section 5.17.3. <br />114 While shown as Red Underlined Text, these are the existing standards governing the development of a <br />cemetery. <br />115 This combines restaurants, nightclub, pubs, bars, etc. into one central land use category.
