Harvey, Planner III (919) 245-2597 <br />Craig Benedict, Director (919) 245-2575 <br /> <br />PURPOSE: To review and comment upon Unified Development Ordinance (UDO) text <br />amendments initiated by the Planning Director at the request of the County’s Attorney office to <br />revise and clarify the operation of the Board of Adjustment as well as streamline existing <br />language regarding submittal of applications to Orange County for processing. <br /> <br />BACKGROUND: As part of the County’s Attorney office annual work plan, the BOCC directed <br />Mr. John Roberts and his staff to review and clarify existing language within the UDO governing <br />the operation of the Orange County Board of Adjustment as well as the submittal of applications <br />for review. <br /> <br />On July 2, 2018, Planning staff received recommended text changes for initial review and <br />comment. <br /> <br />The Attorney is proposing the following: <br />1. Updating and clarifying language in Section 1.8 concerning the operation of the Board of <br />Adjustment; <br />2. Revising existing language associated with the submittal, review, processing, and action <br />on variance, special use permit (both Class A and B), and appeal applications; <br />3. Eliminating language in Section 2.11 Interpretations of the UDO. The attorney’s office <br />believes this contradicts existing language in Section 2.26 Appeals and is redundant. <br />4. Modifying existing language within Section 5.3 dealing with the processing of Special Use <br />Permits. <br />At this time there is no approved timeline for the review of this item. At its September 4, 2018 <br />regular meeting, the BOCC will be asked to adopt an amendment outline form establishing the <br />review timeline (Planning Board review/recommendation, public hearing, etc.) of the <br />aforementioned amendment. <br /> <br /> 6
