Article 2: Procedures <br /> Section 2.3: Comprehensive Plan Amendments <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 2-5 <br /> <br />Special Use Permit portion is quasi-judicial <br />(E) Conditional Zoning District (CZD) -– legislative <br />(F) Variance – quasi judicial <br />(E)(G) Appeals – quasi judicial <br />SECTION 2.3: COMPREHENSIVE PLAN AMENDMENTS <br />2.3.1 Review and Approval Flow Chart <br />The review and approval process for Comprehensive Plan Amendments is shown in the <br />procedure’s flowchart. <br />2.3.2 Generally <br />(A) The Comprehensive Plan shall be so prepared that all or individual elements and <br />parts thereof may be adopted and/or amended by the Board of Commissioners. <br />(B) For the purpose of establishing and maintaining sound, stable, and desirable <br />development within Orange County, the Comprehensive Plan or portion thereof <br />shall not be amended except as follows: <br />(1) Because of changed or changing conditions in a particular area or areas <br />of the County; <br />(2) To correct an error or omission; or <br />(3) In response to a change in the policies, objectives, principles or <br />standards governing the physical development of the County. <br />2.3.3 Initiation of Amendments <br />(A) An amendment to the Comprehensive Plan or portion thereof may be initiated by: <br />(1) The Board of Commissioners on its own motion; <br />(2) The Planning Board; <br />(3) Application, by any person or agency, which accurately and completely <br />sets forth the reason(s) for the proposed amendment as prescribed in <br />Section 2.3.2(B); or <br />(4) The Planning Director. <br />(B) Once initiated, all amendments shall be referred to the Planning Board. <br />2.3.4 Public Hearing Required <br />A public hearing shall be held before adoption of any proposed Comprehensive Plan <br />amendment. The Board of County Commissioners shall hear applications and receive <br />public comment for proposed Comprehensive Plan amendments in a Public Hearing. <br />2.3.5 Notice Requirements for Planning Board Meetings and Public Hearings <br />(A) The Planning Director shall provide notice of Planning Board meetings at which <br />the Planning Board is to review and make a recommendation on Future Land <br />Use Map amendments and Public Hearings at which an amendment to the <br />Future Land Use Map is to be reviewed.
