Article 5: Uses <br /> Section 5.12: Standards for Extractive Uses <br /> <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 5-134 <br /> <br />(h) The site plan has buffer from streams. <br />SECTION 5.12: STANDARDS FOR EXTRACTIVE USES <br />5.12.1 Borrow Pits for Federal and State Highway Projects <br />(A) Use Standards <br />(1) Permitted by right in all districts in accordance with the provisions of Section <br />5.1.1 of this Ordinance <br />(A)(B) General Standards of Evaluation <br />(1) The borrow pit is located within one-half mile of the construction site; <br />(2) An Erosion Control Plan has been approved by the Department of Environment, <br />Health and Natural Resources; <br />(3) The material extracted is to be used solely for a State or Federal road <br />construction project; and <br />(4) Road construction plans include provision for reclaiming the excavated area. If <br />the reclamation plan involves filling the excavated area, the fill material must be <br />inert material defined as beneficial fill by the Solid Waste Branch of the <br />Department of Environment and Natural Resources, provided that the debris is <br />also associated with a State or Federal Highway road construction project. <br />Inclusion of reusable or recyclable materials in the reclamation or filling of the <br />borrow pit should be minimized. A proposed debris recycling program or a <br />statement as to why material will not be recycled must be submitted for review by <br />Orange County. <br />5.12.2 Extraction of Earth Products <br />(A) Use Standards <br />(1) Shall not be permitted as a Conditional Use District. Refer to Section 5.1.3 of <br />this Ordinance. <br />(2) Processing of materials on-site, beyond incidental mechanical consolidation or <br />sorting to facilitate transportation off-site for further processing, is prohibited. 139 <br />(B) Submittal Requirements and Standards of Evaluation for Class A Special Use <br />Permit <br />(1) Submittal Requirements <br />In addition to the information required by Section 2.7, the following shall be <br />submitted as part of the application: <br />(a) 26 copies of the site plan, prepared by an appropriately licensed <br />professional, which shall contain the following: <br />(i) Extent of area to be excavated or mined. <br />(ii) Aerial photograph of site and all areas within 1,000 feet of the <br />perimeter of the property flown within two months of the <br />application for a Special Use Permit. <br />(iii) Existing topography at a contour interval of two feet based on <br />mean sea level datum. <br /> <br />139 This is an existing prohibition contained within the definition of Extraction of Earth Products within Article 10 of  <br />the UDO.  Staff is including language herein to specifically denote the prohibition.  <br /> 113
