Article 2: Procedures <br /> Section 2.2: Applications <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 2-3 <br /> <br />(6) Minor Subdivisions Utilizing the Flexible Development Option. <br />The applicant shall schedule a pre-application conference with the Planning <br />Department. <br />(B) In preparation for the pre-application conference, the applicant shall submit a <br />sketch plan illustrating the location, size and major design elements of the <br />proposed development no later than five working days prior to the pre-application <br />meeting. <br />(C) The Planning Department may request that representatives of other public <br />agencies be present at the pre-application conference, including, but not limited <br />to: <br />(1) Planning Board, <br />(2) Building Inspections, <br />(3) Health Department, <br />(4) Engineering, <br />(5) Parks and Recreation, <br />(6) The municipalities of Chapel Hill, Carrboro, Hillsborough, Mebane, and <br />Durham, <br />(7) North Carolina Department of Transportation (NCDOT), and <br />(8) Utility Providers. <br />(D) The applicant will be advised of the various development standards and <br />review/approval processes for the project as well as any preliminary concerns <br />regarding the project. <br />2.2.6 Application Completeness <br />(A) An application shall be considered complete and ready for processing only if it is <br />submitted in the required form and quantity, includes all required information, and <br />is accompanied by the required filing fee. <br />(B) The Planning Director shall review all submitted applications to determine <br />compliance with all submittal requirements. <br />(C) The Planning Director shall accept or reject an application within five business <br />days from the date of submittal. If the application is not acted upon within this <br />time frame, the applicant shall receive a full refund of all filing fees if the <br />application is rejected. <br />(D) The Planning Director shall notify the applicant, in writing, of any deficiencies in <br />the application and invite the applicant to revise the application to correct <br />identified deficiencies. If or when the application complies with all submittal <br />requirements, the Planning Director shall accept the application as complete and <br />notify the applicant of its acceptance. <br />(E) No further processing of incomplete applications will occur until deficiencies are <br />corrected. <br />2.2.7 Withdrawal of Applications <br />(A) Submission of Request <br />Any request for withdrawal of an application subject to a public hearing shall be <br />submitted in writing to the Planning Director, or shall be made through a verbal <br />request at a public hearing. <br />(B) Prior to Notice of Public Hearing <br />Formatted: Indent: Left: 1.5" <br />Formatted: Indent: Left: 1.5" <br />Formatted: Indent: Left: 1" <br />Formatted: Indent: Left: 0.5" <br />Formatted: Indent: Left: 1" <br />Comment [JCB10]: As a practice the BOA and <br />BOCC likely should cease to make decisions on <br />submittal requirements. <br /> <br />This may have implications on some standards in <br />Article 5.
