<br />~ SAMPLE PERFORMANCE AGREEMENT <br />(See italicized Clause 6. Non-Discrimination Policy for proposed change <br />if `The Agency" determines that it shall .not operate the program or one similar and <br />acceptable to the County during the subsequent year, `The Agency" shall so notify the <br />County in writing by May 30, 20KX, and `The Agency" shall refund to the County the <br />County's pro rata share of the fund balance. Said pro rata share due to the County shall <br />be the same as the ratio of the County's payment(s) to overall revenues of the program. <br />6. Non-Discrimination Clause <br />The SERVICE PROVIDER agrees as part of the consideration of the granting of funds by <br />Orange County, for themselves, their agents, officials, employees and servants agree not <br />to discriminate in any manner on the basis of race, color, sex, national origin, age, <br />handicap, religion, sexual orientation, familial status or veterans status with reference to <br />any activities carried out by the grantee. The parties hereto further agree in all respects <br />to conform to the provision and intent of Orange County Civil Rights Ordinance.
