Harvey, Planner III (919) 245-2597 <br />Craig Benedict, Director (919) 245-2575 <br /> <br />PURPOSE: To review and comment upon government-initiated Unified Development Ordinance <br />(UDO) text amendments revising regulations governing the processing of subdivision <br />applications. <br /> <br />BACKGROUND: On May 4, 2017, Session Law 2017-10 (Attachment 2) modified the review of <br />subdivision proposals by local governments, specifically: <br />1. Created a new category of exempt subdivision, and <br />2. Limited local governments to requiring only a plat for recordation (i.e. a Final Plat <br />application as detailed in Section 2.14.3 of the UDO) for a division of land in single <br />ownership meeting specific criteria. <br />For more specificity, please refer to Attachment 1. <br /> <br />Staff will need to amend the UDO to incorporate these changes in order to ensure local land use <br />regulations are consistent with applicable State law. <br /> <br />FINANCIAL IMPACT: Consideration and approval will not create the need for additional funding <br />for the provision of County services. Existing staff, included in the Departmental staffing budget, <br />will accomplish the work required to process this amendment. <br /> <br />RECOMMENDATION(S): Planning staff recommends the ORC review and comment upon the <br />proposed amendments to the UDO. <br /> <br /> <br /> 42
