If a proeprty bound by a non-conversion agreement is <br />modified to remove the enclosed areas below the RFPE, <br />the owner may request release from the agreement after <br />staff inspection and submittal of confirming <br />documentation. <br />(7) Temporary Non-Residential Structures <br />Prior to the issuance of a floodplain development permit for a temporary <br />structure, the applicant shall submit in writing for the review and approval of the <br />Floodplain Administrator, a plan for the removal of such structure(s) in the event <br />of a hurricane or flash flood warning notification. The plan shall include the <br />following information: <br />(a) A specified time period for which the temporary use will be permitted. <br />Time specified may not exceed three months.; <br />(b) The name, address, and phone number of the individual responsible for <br />the removal of the temporary structure; <br />(c) The time frame prior to the event at which a structure will be removed <br />(i.e., minimum of 72 hours before landfall of a hurricane or immediately <br />upon flood warning notification); <br />(d) A copy of the contract or other suitable instrument with a trucking <br />company to ensure the availability of removal equipment when needed; <br />and <br />(e) Designation, accompanied by documentation, of a location outside the <br />SFHA to which the temporary structure will be moved. <br />(8) Accessory Structures <br />When accessory structures (sheds, detached garages, etc.) are to be placed <br />within near38 a SFHA, the following criteria shall be met: <br />(a) Accessory structures, other than efficiency apartments as detailed in <br />Section 5.5.2 of this Ordinance, shall not be used for human habitation <br />(including work, sleeping, living, cooking or restroom areas); <br />(b) Accessory structures shall be designed to have low flood damage <br />potential; <br />(c) Accessory structures shall be constructed and placed on the building site <br />so as to offer the minimum resistance to the flow of floodwaters; <br />(d) Accessory structures shall be firmly anchored in accordance with this <br />Section; <br />(e) All service facilities such as electrical and heating equipment, shall be <br />installed in accordance with this Section; <br />(f) Openings to relieve hydrostatic pressure during a flood shall be provided <br />conforming to the requirements of this Section; <br />(g) An accessory structure with any dimension that is 12 feet or less in <br />height, width, or depth does not require an elevation or flood proofing <br />certificate. Elevation or flood proofing certifications are required for all <br />other accessory structures according to Section 2.6.4; and <br />(h) The accessory structure shall meet all zoning and building code <br />requirements. <br /> <br />38 Staff is eliminating an existing conflict.  Current regulations do not permit new construction/development within  <br />the SFHA.  Language in this section would seem to indicate we allow for accessory structures within the SFHA.   <br />Staff has determined this was not our intent and have modified this section accordingly.  <br />Formatte <br /> 75
