Article 6: Development Standards <br /> Section 6.21: Flood Regulations <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 6-148 <br /> <br />Letters of Map Amendment or Revision and Summary of Map Amendments, are adopted <br />by reference and declared to be a part of this Ordinance. <br /> The SFHA also include those defined through standard engineering analysis for private <br />developments or by governmental agencies, but not incorporated into the FIRM. This <br />includes, but is not limited to: <br /> Detailed flood data generated as a requirement of Section 1.10.2 (K) and (L) of <br />this Ordinance; <br /> Preliminary FIRMs where more stringent than the effective FIRM; or <br /> Post-disaster Flood Recovery Maps, if available. <br />6.21.5 Compliance <br />No structure or land shall hereafter be located, extended, converted, altered, or developed, <br />improved, or maintained in any way without full compliance with the terms of the regulations <br />pertaining to the SFHA the provisions of this section and other applicable regulations. <br />6.21.6 Special Flood Hazard Areas (SFHA)30 <br />(A) Provisions for Flood Hazard Reduction <br />In all SFHAs the following additional standards shall be met: <br />(1) All new construction and substantial improvements shall be designed and <br />adequately anchored to prevent flotation, collapse, or lateral movement of the <br />structure. <br />(2) All new construction and substantial improvements shall be constructed with <br />materials and utility equipment resistant to minimize flood damage. <br />(3) All new construction or substantial improvements shall be constructed by <br />methods and practices that minimize flood damages. <br />(4) All Eelectrical, heating, ventilation, plumbing, air conditioning equipment, and <br />other service equipment and facilities shall be located at or above the Regulatory <br />Flood Protection Elevation (RFPE) or designed and installed/or located so as to <br />prevent water from entering or accumulating within the components during <br />conditions of floodingthe occurrence of the base flood. These include but are not <br />limited to HVAC equipment, water softener units, bath/kitchen fixtures, ductwork, <br />electric/gas meter panels/boxes, utility/cable boxes, appliances (washers, dryers, <br />refrigerator, etc.), hot water heaters, and electric outlets/switches. <br />(a) Replacements part of a substantial improvement, electrical, heating, <br />ventilation, plumbing, air conditioning equipment, and other service <br />equipment shall also meet the above provisions. <br />(b) Replacements that are for maintenance and not part of a substantial <br />improvement may be installed at the original location provided the <br />addition and/or improvements only comply with the standards for new <br />construction consistent with the code and requirements for the original <br />structure. <br />(5) All new and replacement water supply systems shall be designed to minimize or <br />eliminate infiltration of floodwaters into the system. <br /> <br />30 The Special Flood Hazard Area is referenced throughout the FEME model flood ordinance and is defined within  <br />Article 10 of the UDO as: The land in the floodplain subject to a 1% or greater chance of being flooded in any given  <br />year as determined in Section 1.1.3  of this Ordinance, as defined by the base flood elevation.  The mapped special  <br />flood hazard area approximates the base flood elevation .  Staff is comfortable recommending we keep the  <br />reference to flood prone areas.  <br />Formatte <br /> 69
