Article 6: Development Standards <br /> Section 6.6: Additional Standards for Overlay Districts <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 6-36 <br /> <br />(a) Under no circumstances shall modern corporate franchise building <br />design be permitted. <br />(b) Franchise or 'chain' businesses desiring to locate in the Efland Village <br />Overlay District shall be required to design the building in accordance <br />with these guidelines. <br />(c) For purposes of this Sub-Section, "modern corporate franchise building <br />design" means a building design that is trademarked, branded, or easily <br />identified with a particular chain or corporation and is ubiquitous in <br />nature. <br />(2) Human Scale and Fenestration <br />(a) New buildings shall be designed to contribute to a human scale. Large <br />expanses of blank walls shall be discouraged and fenestration (the <br />arrangement, proportioning, and design of windows and doors in a <br />building) and/or design features (such as brick coursing changes, <br />decorative architectural features, patterns of paint, or murals) shall <br />should be provided in such a way that a building is relatable to humans <br />and does not overpower the area. <br />(b) Additions to existing non-residential buildings should be designed to both <br />complement the existing building and achieve human scale to the extent <br />feasible. <br />(c) The functional use of the building should be considered when <br />determining design features and fenestration. <br />(3) Mirrored glass is discouraged and in no case shall comprise more than 50% of <br />the building façade. <br />6.6.56.6.4 Major Transportation Corridor (MTC) <br />(A) Landscaping and Buffers <br />In addition to the requirements set forth in Section 6.8 of this Ordinance, the following <br />standards shall be met: <br />(1) A minimum of 100 feet of buffer area from the edge of the interstate highway’s <br />right of way, shall be preserved. The purpose of this buffer is to protect, preserve <br />and promote the visual appeal, character and value of land adjacent to major <br />transportation facilities; to provide for the separation of spaces; and to promote <br />the public health, safety and welfare through minimizing potential nuisances such <br />as the transmission of noise, odor, dust, litter and glare of lights. <br />(2) In areas of dense mature forest, existing vegetation may be used to fulfill the <br />buffer requirements. Where there is no existing vegetation in the buffer area, or <br />if existing vegetation does not provide a sufficient buffer, all proposed plantings <br />must be shown on the landscape plan to fulfill the buffer requirement. The new <br />plantings shall be predominantly evergreen and shall reach a mature size of at <br />least 30 feet. New trees shall be located so as to establish at maturity a <br />continuous screen in the 100 foot buffer area along the adjacent interstate <br />highway. <br />(3) Landscaping shall be in accordance with an approved landscaping plan. <br />(4) Any areas left in a natural state shall remain undisturbed except as follows: <br />(a) Within the buffer areas, necessary ingress, egress and utility service may <br />be allowed, but no other disturbance for site improvements shall be <br />permitted. <br />(b) Selective clearing of vegetation may be allowed only to remove diseased <br />trees or trees weakened by age, storm, fire or other injury. <br /> 66
